Uh, oh! Some semi-literate chucklehead is not happy with FFFF! We received an e-mail from an under-educated police apologist who wishes that we would turn our attention from the Fullerton Police Department record of bogus traffic tickets, theft, drug-abuse, credit card fraud, kidnapping, kidnapping and sexual battery, kidnapping, abetting suicide in the city jail, and, of course, the Kelly Thomas homicide; and instead focus on “what the fullerton police does (sic) for you to keep you and your fellow fullerton citizens safe.”

Safe, huh? Safe from what? The greatest threat to our “fellow Fullerton citizens” these days seems to come from the FPD itself.

Anyway, enjoy the amusing version of “The Truth” as penned by some poor, high school drop-out:

Goodrich, it looks like mistakes are made quite often in Fullerton. Emmanuel Martinez & Veth Mam both detained and taken to trial for crimes they never committed. How many others are out there?

        It’s been 40 or 50 years since the Supreme Court last visited this issue, and when it did it determine that the US Constitution does not guarantee that only the guilty will be arrested and detained. If it did every suspect released and every defendant acquitted would have a cause of action.

        That being said, if it can be shown specifically that a pattern exists of FPD officers arresting and detaining citizens without making a good faith effort to avoid disrupting the lives of innocent folks, then the Martinez case might be actionable.

        1. It seems this situation was a flagrant disregard of the truth. FPD checks the video to ensure their reports are correct when they kill Kelly Thomas, yet they don’t check their tapes to ensure the correct person was detained after a line-up. Then Emmanuel Martinez locked up for months until his attorney can prove this in court. Seems like the officers had an axe to grind. Great people over at the FPD.

        2. Except that they made no effort to get the right guy. Probably too lazy to even correct their original f-up.

          Read the story. Audio existed that proved they got the wrong guy, and a modicum of effort or honesty would have fixed the problem. The incompetence (giving them the benefit of the doubt) was compounded by deliberate falsehood.

        3. A bit off topic but…

          To cut down on wasted court time and money from frivolous law suits, some states have instituted a looser pays system in civil court that seems to work fairly well. How about the same deal for the criminal (or at least traffic) courts?

          It sure would cut down on the bullshit of overcharging suspects to get them to plead out to lesser or reduced charges and just might restore some confidence and credibility to the criminal justice system.

          Anyone who has been to traffic court in the last several years knows that this system is already in place for one side. In addition to your traffic fines they have found dozens of ways to charge you with civil penalties as well to cover their costs. Even if you have charges dismissed you are often still required to pay some type of dismissal fees. WTF! They want us to financially participate in our prosecution!

          I’m sure cops would give out far fewer bullshit tickets if they knew that when they got beat in court they (or their department) would have to pay. Don’t know about you but I’m sick and tired of being treated like the states ATM machine.

    The FPD is a skewed model that has been manufactured by a flawed process and the result is a substandard product.
    If the flawed product causes harm to the user, the producer is liable. My times this will be the driver for the producer to seek bankruptcy protection.
    The FPD and several senior Fullerton city leaders are morally and ethically bankrupt.
    In this case, the FPD and Leaders must be replaced and no remnants can be permitted to contaminate a new organization.

Too bad you don’t realize what its like to have to explain to kids that the police, those brave heroes whom they have looked up to since they were little, beat an innocent man to death and that’s why all those flowers are there. How many parents do you think have had to have this conversation with their kids in the last 2 months?

      Cops reading this – do you want the kids of the community you serve to be scared of you? Doesn’t it make you feel sick inside to know this is happening all over your city? That a whole cohort of little kids are going to identify policemen with murder?

      If I worked at FPD:

      3. I’d be looking into State of California whistleblower protection law
      4. I’d be looking for a new line of work

      1. Of course they want the kids to be afraid of them. That is the philosophical basis of that department, and it has been for years. When everyone fears them, their job is done…and done well. And those patrolling our streets are intentionally selected as inferior and ignorant so they won’t question the “rule by fear” protocol and then their conscience won’t get in the way (being they don’t have one).

        And if anyone thinks that someone is going to step away from that department and do the right thing, you are smoking something whacky.

        For me personally this was the worst part of the criminal act and tragedy. I was up north at our condo with my 11 year-old daughter and her best friend. They had just returned with me from a mtn. bike ride. We were tired and maybe that’s why, for once, they didn’t leave the couch when I turned on the news early last August and first heard the story of the murder of Kelly Thomas.

        They weren’t sure what was going on, didn’t catch the details, but their curiosity was aroused and they asked me, “What happened?” I explained to them that several cops beat a homeless man to death back home on OC, not far from where we live.

        To say these little girls were shocked is beyond an understatement. “Why? Why did the police do that?” They asked.

        I had to explain to them that not all cops are really good guys like our neighbor down the street, whose daughter is in their circle of friends. “They aren’t all like Brianna’s dad.” I saw in their eyes how deflated they were. Their rainbow world of horses and American Girl Dolls had just become a lot gnarlier, permanently. Man that sucked.

        I came home and started writing posts on the subject to the OCR site, and eventually found my way here, where a few otherwise like-minded folks have apparently decided I’m Susan Kang Schroeder! But that’s another kinda sucky story… LOL

            Xer, did you miss the fact that the poster of whom I asked the question shares the same first name as attorney Cabaniss? This is why I was curious if I was addressing Cabaniss himself or just coincidentally another ‘Mark.’ No implication of conspiracy was intended.

            As for defending T-Rack, as I’ve written elsewhere, I don’t give a shit about the DA personally. He may very well be an evil asshole, but I do have a theory of what’s going to happen down the line, and because my theory is that the DA will and must charge the cops with serious crimes, I’ve been put in the position of having to defend the delay in charging and explaining why I believe it’s not evidence of a cover-up or a grand conspiracy. And yes, defending the DA on other points as well, as I did here. Example: If I thought the DA was indeed ‘conceding points’ to the cops’ defense as Mr. Cabaniss asserts above, then I would be forced to reexamine my theory, but when I see that Cabaniss’ logic is faulty and based on a misreading of the article he cites, I point that out in defense of my own theory. Is this really that hard to understand? I mean I’ve assumed that the cheap shots at me for supposedly wanting to “blow the DA” and such were just that, cheap shots by small minds, but you seem to be smarter than that, so I’m surprised you also jump off and on that bandwagon.

            Unlike most here, I’ve stepped up to give an unpopular theory and to defend it. For example, when asked to give my opinion as to a specific time frame with regard to the OC DA’s charging or not charging the officers who murdered Thomas, I stepped up to the plate and answered the question.             Allow me to say, I almost always enjoy reading your posts, as they sometimes offer a different, yet not illogical perspective stimulating different trains of thought. And, you do seem genuinely interested in justice for Kelly.             Not to blow my own horn too much, but my answer was “maybe as short as a week” to the question of when I thought charges might come down. That was last Monday. Tonight I’m reading on FFF that “the DA has hinted that he may make a big announcement about the cops who killed Kelly Thomas as early as (this coming) Monday.”

            This would make sense… it’s been about ten weeks since Kelly’s death, the same approximate amount of time it took for the autopsy to come down in the Costa Mesa City Hall jumper Huy Phan suicide last spring.

            Believe me, I really hope the evidence is there in Thomas’ autopsy to allow for a vigorous prosecution of his murderers, but I’m worried… I know how these things go, and despite outward appearances (many eye witnesses, surveillance video) the DA has a difficult uphill fight ahead if he hopes to get convictions of police officers on serious charges here in OC. An ambiguous or less than favorable to prosecution autopsy will sink any chance of that, and leave a lot of us angry and disappointed (understatement here).

            Thanks for the thoughtful reply, and yes, I can see how my position could lead to the conclusion that I’m a cheerleader for the OC DA, and that sometimes I write things which “seem contrary to other things” I might say, that’s just me, I’m not a linear thinker at all and my visceral response is to always reject group think… a true child of the 60s I guess.

    I had to explain to them that not all cops are really good guys like our neighbor down the street, whose daughter is in their circle of friends. “They aren’t all like Brianna’s dad.” I saw in their eyes how deflated they were. Their rainbow world of horses and American Girl Dolls had just become a lot gnarlier, permanently. Man that sucked.
    I came home and started writing posts on the subject to the OCR site, and eventually found my way here, where a few otherwise like-minded folks have apparently decided I’m Susan Kang Schroeder! But that’s another kinda sucky story… LOL

    1. That may be true, but we all know why arrogant douchebags coming out of downtown restaurants and getting into their Ranges aren’t beat to death: Money makes one far, far less defenseless in our society.

      In Kelly’s case the cops probably weren’t too worried about getting in trouble. They had no idea that Kelly was much loved and cared about by a man and his family who weren’t just going to accept Kelly’s violent passing as an inevitable end to a long-term family problem.

      For me this is what makes the apologist’s refrain here that “Dad Thomas didn’t care about his son” both appallingly obnoxious and laughable at the same time. It’s precisely because he loved and cared about his son and wanted justice that he turned down a million dollar settlement, while the cops who murdered Kelly are instead facing the very real possibility of going to prison. Many, if not most, families probably would have taken the money, and in their heart of hearts considered the circumstances of Kelly’s demise as something of win/win: No more disruptive and troublesome mentally ill family member to deal with, and a million bucks in their pocket. It sounds cold and heartless, but it happens. Just not this time.

    Based on all this BS and what has been done the PD6 can never get a fair trial, therefor will never be convicted.

    How are people supposed to react when those sworn to protect, murder an unarmed man who couldn’t stand up in a strong wind without being blown over, all while under the color of authority?

    Everything this blog and the folks protesting the outrageous behavior of those responsible for murder of Mr. Kelly, have been well within their rights and signify that the American Spirit is not dead when it comes to the expression of unadulterated outrage towards elected’s and those employed on the public’s purse.
