The OC Register is reporting that Jay Cicinelli, the man we watched smash Kelly Thomas’s head with the butt of his taser is no longer employed by the people of Fullerton.

According to his dear old stepdad, John Huelsman, he was fired for policy violations and excessive force, a charge Cicinelli will be fighting.

Of course for those who watched the snuff video, and later heard Cicinelli’s admission that he smashed Kelly’s face “to Hell,” this action was a no-brainer. Even though the DA charged this creep nine months ago with manslaughter, the Fullerton Police Department and the Three Bald Tires permitted the investigation sham drag out for over a year before cutting Cicinelli loose.

    1. I’ve watching this story unfold for approximately a year since the Kelly Thomas story made the news (I live in the Midwest). Weren’t Cicinelli and Ramos supposed to go to trial July 13th? I see that Cicinelli was fired from the FPD; when do these 2 bozos (Ramos and Cicinelli) go to trial? Why isn’t Wolfe on trial? Congratulations on winning the re-call, but until these goddamned cops go to prison, nothing will change in Fullerton. I’ve been following some of the articles in FFF; haven’t seen much on the arraigment, upcoming trials (I did see where the pre-trial was postponed last spring).

        If a police officer is acting in his official capacity, you cannot put a restraining order on him.

        You are instead advised to contact their Supervisors, who in my experience, have more contempt for the public than the original offensive officer that caused you to seek out the Supervisor…(apple doesn’t fall too far from the tree?)

        And if you don’t like it? Well, you still have to pay for it, and the cost of the public safety budget in Fullerton to us residents is over $50,000,000.00 per year!

  3. Bad news. The request I made to the city council for the dispatch transcripts won’t happen. The D.A. will be asking the court to put a restraining order on the call by Monday. (Email I got from one of the councilmen this morning.

    This proves the call was made. Why else would he want a restraining order. We need to protest once again at Ra-cock-ass’s office!

      Consider a contrast in this case between the attornys for the suspects and the attorney for the people of Orange County and the victim.

      A while back, a major development occurred when that bouncer filed a lawsuit against the Slidebar. He claims he was wrongfully terminated for telling DA investigators the truth that Kelly wasn’t lifting any car door handles but was harmlessly milling around for cigarette butts at the transportation center like he always did that time of day. That news was a blow to the defense and those who want to sully Kelly. A counter story was needed. FPD staff investigators then called the DA to tell them they had noted some audio where Ramos appeared to be courteous to someone. This wasn’t new evidence. The defense lawyers already had that audio. Yet, the DA promptly passes along word to Barnett who runs to the media trumpeting, “game changer, game changer!” He was actually able to further delay the arraignment and trial based on that insignificant information.

      That audio wasn’t a game changer at all of course. The overwhelming game changer was that a member of the Security staff where the call was initiated had reported to the Orange County District Attorney that he was an eyewitness of events and that Kelly was fully innocent of even minor offenses that night. Now, does the DA trumpet this fact to vindicate the victim? No, he hides the information and tries to suppress public awareness of the truth. Oh yeah, there is an investigation. You do realize, Mr. DA, that investigations are meant to uncover facts and not to be misused as an excuse to bury them, right?

      Will that bouncer’s lawsuit quietly disappear before any court hears this information? Maybe, but more likely, all the facts will come out despite the efforts of anyone trying to mitigate culpability in this case. Justice for Kelly isn’t achieved by sending Ramos and Cicinelli to jail for a year or two. Justice is served by allowing the light of truth to openly shine on this case without obstruction.

      1. Yeah but this time the DA is walking a tightrope with a bed of nails below, the outraged public at one end and the police unions at the other end of the rope with their fangs gleaming in the light of day. This case will make or break him. It is never too late to do the right thing.

His attorney is going to put all the blame on the City of Fullerton for hiring a grievously injured and psychologically traumatized individual and placing him back into highly stressful situations- in essence returning him to the same environment where he almost lost his life. I hate to say it, but his prosecution is gonna be difficult-ADA will probably also be a factor. The city had a duty through its hiring process to not give in to sentimentality- ironically, this same argument will probably be used in a civil case under the negligent hiring/retention doctrine. Anyone at FPD or the city-current or retired- who was involved in the hiring process and did not make written notations against hiring him is subject to subpoena. Just my opinion and I welcome opposing viewpoints.

As usual, the system that claims a “higher standard” took over a year to fire this filthy pig whereas if a WalMart Greeter committed the same heinous act he would’ve been fired the day after the murder. It took this long or longer to fire the other dirty pigs who lost their jobs. Imagine of you were a bank clerk and got caught on camera stealing a laptop from a airport security area. Would you stay on the payroll for months and months while the bank investigated your crime?

    Why is it that if someone were collecting Social Security Disability benefits committed a crime that they would automatically lose their benefits while incarcerated or on probation, yet the police officers who are in the same boat continue to receive their disability or retirement benefits?

          FYI– that’s the same standard of care from a tort perspective for any citizen. Had I sat on someone until they passed out and they died later, I’d be liable for not rendering aid if I just stood around laughing with my buddies. By exercising the use of physical force (lawfully or unlawfully,) the officers undertook a basic duty to care.

          Cops undertake an additional duty of care just by wearing a badge (i.e. they owe a duty to ANYONE in distress– not just those they put in distress), which just makes things worse. They should be fired, they should be sued, and they should lose– just like any of us would.

With cops like Benjamin Lira collecting money to bail the murderers out of jail, Chief Sellers orchestrating a cover-up, and Hughes not showing any transparency or accountability for the murder, it makes me wonder why the decent cops in Fullerton would continue to work for force that is an organized crime syndicate.

  16. Brandon, the emphasis on policing (some, not all) has become too militarized, too focused on “fear” of the community than anything else. Community policing is just a novelty idea and it’s only a ploy tactic to present to the community. Honestly, there is no such thing as community policing, other than idea. Police officers get off on the adrenaline rushes and literally some cannot wait until the “big call” of the night. Reaching out to the community, ensuring safety measures, etc. is a nuisance to them and could care less. Police departments have adopted this bad ass attitude and is becoming more and more detached from society. The ignorant higher ups, hire more ignorant assholes every single day. We don’t live in an uncivilized society, however, we are becoming more and more a police nation each day. The Officer’s Bill of Rights needs to be changed, big time. TOOO much protection and personal accountability. I believe society’s/city council need to be more involved with police departments so they can keep a watchful eye on what’s going on. It’s the only way to keep so much power honest. Transparency, accountability, and public knowledge has to become more prevalent or else the police departments will continue to police their own, protect their own more, and get to the point where nothing or no one will be able to penetrate their protection. The citizens have the right to know exactly what is going on with the protection of their community.

    1. Problem is that Fullerton is proving to citizens, lawmakers, and politicians why it is so important. Easy in a case like this just to fire everyone for fun. Even responders who did nothing wrong. Pobar proved its importance and value. It’s not going anywhere.

There is no reason to give police the right to protect themselves from prosecution more than any other citizen. They cannot police themselves and the community must have authority over them and access to all of their professional records.         What sentence did ex-Fullerton Police Officer Albert Rincon get for sexually assaulting residents while in uniform?

  30. I used to work at Whittier Christian – specifically the campus where Trina has been hired to work at – and I can tell you that Jay’s type will be welcomed and supported there. There are a couple people on staff who truly believe and practice the things that Jesus teaches, but by and large they are the type that will see Kelly as some sort of moral reprobate because of his illness and Jay as the unfairly prosecuted saint who was just tryin’ to keep us good Christians safe.

I agree about trying to convince themselves. They have managed to convince themselves that Kelly Thomas was the criminal, and Jay was innocent. But Kelly Thomas had no Felony convictions. We won’t be able to say that about Cicinelli for much longer. Kelly Thomas’s dad admitted that Kelly was volatile when he wasn’t on his meds. The Cicinelli family has offered no information on what meds Jay was taking and why he was off them at the time of his crime. I think the support for each man is the best illustration of what type of people they were and families they came from. Jay Cicinelli has the support of his wife, sister, step-dad, and a few cops who for all we know participated in the murder. Kelly Thomas has the support of thousands, with dozens of citizens claiming he was a kind, gentle soul. I have yet to hear any kind words about Jay, outside of his family. Even his fellow officers talked about him bragging about murdering Thomas and giving cops a bad name.

  42. I’m hardly jaded on Christianity, merely frustrated with how many American Christians practice what they claim to be their faith. I myself am a Christian, but I seem to have a different set of priorities than many of my “brethren.” And if you think we have been a nation steeped in the actual teachings of Christ and the early church, you need to reread our history and seriously think about what you said. You assume too much about me and about our country’s past/present…but that’s a different discussion for a different time. While there are many things about America that I love and cherish (I wouldn’t want to live anywhere else), there are some hard truths that we refuse to acknowledge – truths that have been brought to light by the killing of Mr. Thomas.

    Trina Ciccinelli is part of the issue. Just as members of the Fullerton police department did nothing to intervene in Mr. Thomas’ alleged murder (or condemn the actions of the Ramos and Ciccinelli – even after they had been charged and fired in connection with his death), Trina Ciccinelli has done nothing to publicly come out and condemn the person that posts on here as Jay’s sister. The very least she could do is say that the person who comes on here and blasts the Thomas family routinely is an impostor. That would at least give her plausible deniability. I seriously doubt she is unaware of what has been said in her family’s name.

    The point is that while Whittier Christian is free to hire whomever they wish (heck, they hired me at one point), there are considerations to be made about the type of image you want to project to the community you purport to serve. Again, they are free to hire whomever they wish, but we are also free to criticize and draw inferences about the sort of people they want teaching the children that go there.

    Wolves-in-sheep’s-clothing called out all the time at churches? Hardly. These tend to become the most vocal and powerful elements of the “Christian” community. But this is not about that. It’s about whether or not someone whose husband is accused of contributing to the death of an unarmed, mentally ill person – and who has remained silent while her husband’s supporters have said terrible things about this person and their family – is morally fit to teach children when they have done nothing to publicly distance themselves from the ugly aspects of their situation. I would expect Trina to support her husband throughout this whole ordeal, but I would hope that she would have at least distanced herself from the ugly and terrible things being said by those who claim to be on her side.

  56. The only bashing into the curb was when KT fell because he was not obeying commands. That’s where the bloody nose came from, his own doing. At no time were one, two, or three officers on KT. His throat was not crushed. Read the reports dude! Broken ribs a result of compressionn from EMTs. Autopsy photos were clean.

    KT’s poor physical health resulted in his death.. nothing more. Who caused his deteriorating physical condition? Not the officers!!!!!!!! KT was not taken care of. He needed medical attention in a bad way and did not get it. No one attended to his needs. No one. As a result, he died.

    The officers should not take the heat for the lack of care to KT. Stuff happens whether it was the Thomas family or KT’s choice, stuff happens and possibly no one was to blame. But the Officers were not responsible! You need to get over it and go on with life. Oh yeah, and what about his heart condition?
