OC 4th District Supervisor Shawn Nelson visited our humble blog yesterday to refresh our memories about his calling in the Feds in the Kelly Thomas killing. Here’s what he had to say:

So the historical record is clear, I contacted the Department of Justice on Thursday July 21 or 28 (not sure which Thursday off the top of my head). My purpose was to open a case file in the Civil Rights division because I felt an obligation to ensure the citizens of Fullerton everything I could do had been done. While on the telephone with a lawyer at the DOJ, she contacted the FBI and before our call concluded she was able to confirm that the FBI would be taking the lead on the case and that the FBI had, in fact, opened a file as of that monement.
Confirmation of the FBI’s involvement made the airwaves later that same day and by 8:00 the next day I heard word the officers involved had been taken off the streets.
A good reminder that the cops weren’t pulled until after the FBI was notified on July 28th, 2011. A coincidence? I think not.
FFFF originally posted about Nelson’s intervention, here. I also believe it was this action that spurred the DA to do a real investigation, and not one of the usual whitewashes.

Shawn Nelson was not the first person to contact the FBI, that had already been done by some of the persons involved. With nothing to hide by the participants, they wanted a complete and fair investigation.

Rackaukaus’ office was also called that same night and they refused to come out to the scene. When told about the incident they did not see a problem and refused to do anything. There is proof of that occurrance.
If the DA refused to come down, it was probably because Hughes told them he saw nothing wrong with the beating.
That’s an outright lie. The FPD alerted the DA about the incident and a possible investigation, per policy, and then did NOTHING. The DA had to make repeated calls back to the FPD to get the official invitation to investigate.
Maybe Mr.Nelson can use his influence to insure Chief Sellers is properly investigated as to his culpability in this debacle?
The statue of limitation is far from over.
I am sure Mr.Nelson has been around long enough to figure out this tradegy does not just involve 5 patrol officers and a Sergeant.
To allow just those individuals named thus far to be held accountable, would be an injustice in itself.
There is much more to the story, and we all know it, so should Mr.Nelson.

Finally a politician willing to Rein in the reckless pension spending that has plagued our state starting from his own seat.
This is unheard of. He states in the interview that “I am the only employee of 18,000 some employees of the county under the age of 65 that does not take a pension,and you must legaly either be in social security or in a government pension. I’m in neither right now.” ( now thats sompthing to brag about.The three city councilmen in fullerton being recalled would never think of doing that yet they accuse Tony B and his freinds that wish pension reform of buying out fullerton with self serving intrest.
Shawn Nelsons philosophy is to “Start with us and lead by example.” He wants to “Start at the top so nobody can accuse us of going after the working men and women.”
This will be on the ballet in June.Pension reform. Voters can mandate the board of supervisers can opt down to the lowest pension offered by the county 1.6 percent ant age 65. currently 2.7 at 65. “Thats how we got into the mess in this state.”
Reckless pension spending for part time positions with term limits . The best talent is not necissarily the positions with the largest payout according to popular opinion. It is those who are willing to serve the community first and still take home a good stipend to suppliment income they already take in from other exsiting full time positions they hold.

I’ve contacted his office a few times with issues that I wanted to talk about, but never a reply. Even though he came out to one or two protest, he has not done anything else or worked with anyone that I know about to seek justice for Kelly. Why is he bringing this up now? Oh that’s right, it’s election time.

Why hasn’t Nelson made a stink over the way many of the OC Sheriff internal probes are handled? Did he notify the FBI about the Manuel Loggins shooting where the decorated black Marine sergeant was gunned down in cold blood as he sat in the front seat of his car only feet in front of his 2 young daughters. As a County leader did Mr. Nelson send a sympathy card to the Loggins family??? Did anyone in County government send a sympathy card to the Loggin’s family?
There is a case where OC deputies have been found liable in Federal court for assault under the color of authority, illegal entry and false arrest w/o any follow-up investigation provided to the public. There was no indication that any of those cops were fired. And it cost the taxpayers a big chunk of change to defend it and to pay the award. Why doesn’t Nelson squawk and complain about that and DEMAND a follow up review???
There are NUMEROUS other OCSD acts of malfeasance and blatant violations that have cost the County dearly over the last several years.

Bringing up Manuel Loggins reminds me of a case in brea 20 years ago, where a teenage boy was charge with some kind of drug violation. I remember the dept somehow made him an informant for the police that resulted in the teens death and his girlfriend raped and beaten. I remember they were found in a drainage pipe somewhere. Are these people still around that were responsible for that? and if they are, why?

Imagine the emotional scars those kids will have for the rest of their natural lives. Imagine watching your father getting blown away by a cop as the victim sat only a couple feet in front of his young daughers in a car. Nobody’s life was in imminent danger except for the victim who the cop killed in cold blood. And I heard that he was back on the job.

I agree with you. We need zero tolerance of police brutality. That means in ALL jurisdictions. That’s why getting OCSD to replace FPD is no solution in of itself, if we don’t have strong oversight over OCSD as well. Of course, in this town at this point we the citizenry will do the oversight ourselves if our elected officials won’t step up.
Interogating 2 little girls for 13 hours seems criminal, Seems like someone needed to intimidate them in order to keep their mouths shut. how does that improve public opinion? 2 little kids don’t know their own rights, or the right to remain silent when they are distraught over their fathers shootihg in front of their own eyes.
I hope they become Lawyers and work to spare society of these ills.
Not only that. The cops barred the mother from having contact with her 2 girls for those 13 hours after the kids witnessed their dad being blown away by a cop. You know it had to be a self-serving interrogation technique to elicit the ‘correct’ answers from the traumatized girls. That in itself should be a jailable offense. Don’t those bastards have a scintilla of humanity in their souls? And that’s a huge leap of faith that they have any souls at all.
No, only sociopaths would allow that to happen.

It’s my understanding that Nelson originally signed up for the County defined pension and rescinded it only after he was called out since he ran on an ‘anti-pension’ platform.
I have learned to trust NO politician. We have to watch them like hawks.
Look at the big pension entitlement that Moorlach (Mr. Austerity) is in line for when he leaves county service!!!

I know that Shawn Nelson could be in a position to for recommending the implementation of a law that would
force the mentaly ill people off the streets and into treatment The implementation of “Lauras law”. Is Shaun Nelson really taking a paycut because he wants to get re-elected. I can’t begin to believe that when I look at the totality of his service.

Thier positions are very clear
The first thing you see on Jerry Browns is a statement of how he hopes to end our fiscal crisis by raising taxes.
Shawn states “Government spends too much, wastes too much and taxes too much.”
Those who enjoy getting free handouts will probably not like Mr. Nelson and think of half-truths that will undermine his credibility.
No comparison, mere words are meaningless. Watch what Nelson does. If he walks his talk – good. But never believe anything a politician tells you. None of them.

It appears to me that the case has already been sabotaged. Does it make any sense to you that Cicinelli was only charged with manslaughter after turning Kelly’s head into hamburger?

Its a numbers game for the dark side. 33:33 film or 6/6/+6 officers on the scene= 666, or 2 officers x33x33=2178 /6 officers involved =363 days and that will be the trial date of 5-7-13. date of prelim 5+9+12/2 officers charged=13 and 13 sheriffs which stood and faced the courtroom that day as the ruling was read, black stone rings—-way too much for me.

For your information, I have severe bipolar disorder. I spent 25 years of my life in California. I was born in Escondido. I understand Kelly Thomas, and I sorta understand Ron.
The mental health system in California is a POS, and some people are too sick to know they need help. The only reason I’m alive tell you this is because I ended up receiving care in another state. This included a court order for treatment on a mostly outpatient basis. I’m also not afraid to use my legal name when telling my story.
Every time the anti-Laura’s Law people mouth off, I want to throw up a little. They don’t care about Kelly’s life. They care about some abstract “right” to wander the streets in a daze, sleep in parks, and eat out of garbage cans.
To be sure, the FPD killed Kelly Thomas. I support a lot of what is said on this blog insofar as taking care of Fullerton’s end of the problem. But this incident isn’t going to help homeless people with serious mental illness unless Orange County steps up to the plate.
