Pat McPension Gets Leash Yanked

Releasing his inner She Bear may be problematic.

Yesterday, on another thread folks were asking about the upcoming vote for next year’s mayor. I’ll be doing a post on that, real soon. In the meantime enjoy this post by the Desert Rat that was originally published on December 13, 2010. It includes some valuable video in which you may watch the Three Deaf Dinosaurs in action.

Well, that didn’t take long. Mr. Pat McPension, he of the $215,000 a year pension (yes, you read that right), exercised his second vote in office denying the Mayor Pro Tem job (if you believe in things like fair rotation) to Sharon Quirk-Silva. SQS’s problem is that she is a Democrat, and hence, in some people’s eyes, the embodiment of all evil.

Now why would Pat McPension stick it to a woman who actually endorsed him in his recent election bid? Well, if you don’t know that answer you haven’t been paying attention to Fullerton politics for the past 30 years.

Aha! Lois Godfrey. Queen Bee of the Raymond Hills Repuglican Women, an organization dedicated to promoting RINO candidates just like Pat McPension. In fact her husband was the worst one of the bunch. These idiots actually think Doc Jones is a real conservative!

Now Lois and her electric blue-haired gaggle have been backing these zeroes since the 1980s when their patron saints were Dick Ackerman, Buck Catlin, and the hideous gargoyle, Linda LeQuire.

And of course let us not forget the role of Little Corporal, Ed Royce, for whom no candidate is too old or stupid to be foist upon Fullerton for his own purposes.

So McPension owes his dubious political accomplishment to these worthy repuglicans; and at the first opportunity they must have made it very clear to their new boy what was expected of him from those who got him elected.

Just for the Hell of it I added Sharon Quirk-Silva’s pretty dignified admonition to her colleagues after the vote. While I don’t agree with a lot of her politics, I will note for the benefit of the brain dead repuglicans whom I know read this blog:

Quirk voted against the illegal Redevelopment expansion. She voted against the worthless Richman housing project. She voted against the idiotic Transportation Center Master Boondoggle. Your repuglican heroes voted for all three!

So go stick that in your blue wigs and smoke it!

  2. I like Sharon. She is probably the classiest council member we have had in several decades. With her and Bruce I am remotely hopeful that HeeHaw will quit early.

  3. I love the reference to his book. It seems that the She Bear was let out of her cage only long enough to win an election. She was then promptly neutered and assigned to circus ring #3.

  4. With Sharon cast out, Fullerton is now being led into 2011 by Idiot Jones and I need a nap big time Bankhead. McKinley’s trying…but maybe the recount is getting to him or perhaps he’s trying to hard. Overall this panel gets a big useless “thumbs up”. I fart in their general direction!

  9. Good reminder in advance of the Dec. 6 meeting to choose the next mayor. The only way the three stooges can avoid looking even more foolish or arrogant is to make Whitaker or Q-Silva mayor, and we can count on them not to do it. Instead they’ll just dig themselves in deeper by having Jones hang on to the wheel or shift it back to Bankhead. Even they aren’t dumb enough to hand it to McKinley, who would seal their fate once and for all. The only question in my mind is what Whitaker will do. Itcan’t be easy for him to back a Dem in an election year.

          Then Quirk called for the Chief to be fired for not doing his job which is to protect Fullerton residents from killer cops on the street.

        3. Happy Tuesday is right. She did make some bold statements regarding accountability in late July and early August when the hapless three were hoping to hunker down and ride out the storm.

          In an email sent Friday [July 29] to Fullerton City Manager Joe Felz, Quirk-Silva wrote: “I not only request, but demand that action be taken to remove all police officers involved with this incident. Every time a siren goes off in Fullerton a wave of concern settles in.” Source

And in a letter today to constituents, she offers further reasoning. I feel that the leadership required from our chief during this crisis
          was lacking,” wrote the lifelong Fullertonian. “Citizens of Fullerton need to have confidence in a police chief who can not only provide expert, professional crisis management, but who is capable of being the face of the city when a police crisis occurs.           It is also true that she was somewhat wishy-washy at the same time and wanted to shift the focus towards the homeless plight and away from the larger issues of City Council dysfunction. She did, albeit minimally, get out and speak to a city that wanted answers.

      2. And in the meantime she has stayed hidden under her desk until it all goes away. This inaction is just as corrupt as the rest of them, if you ask me.

        If she had real chutzpah she would vocally stand up to the rest at any chance she had, like the council meetings for a start. She is trying to protect her ass and that is it.

        1. 100% agree. That’s the stuff I’m talking about. The other 2 have done nothing in terms of outspoken support. They are politicians. They are playing the political game. They have it perfect right now. Don’t say anything and they have both the FFFF group in their pocket, as well as the other side. Standard politician move. Or the other tactic I spoke of many times. Just say nothing.

    1. There will be plenty of good candidates to choose from – except from the Rotarian-type stooges who won’t dare run in a recall against the Three Dried Up Dinosaurs.

    2. True, her record isn’t perfect, but she voted against the illegal redevelopment expansion. That was a major break with important fiscal implications for the city. There will be a few good candidates, don’t worry.

            1. I have as much inside information as you do as to how the recall of the 3 will play out and who will get elected in their place if the recall succeeds. That’s what I was referring to. So yes, smugness? Maybe. Reality is reality in stuff like this. Just because you are blind to what reality is, doesn’t mean reality isn’t reality!! 🙂

                It is your apparent attitude of smugness that bothers me. Just because there seems to be a perennial problem with government corruption does not mean we should sit back complacently while citizens are being robbed, beaten and killed, all under the color of authority.

                There just some things that are wrong, and anyone with a little humanity would be able to see it. I know there are no easy solutions, but we should never give up striving for a truly civil society.

                Isn’t that what we are supposed to be in this country? The big changes in this country have always come about at the grassroots level. Think about the Civil Rights Movement. People were sick of the abuses.

                I believe now that many, many people are are sick of the abuses of the politicians, and really sick of LE attitudes. History has proven that things can change, and it’s possible now with all the technology, that LE will change for the better. It may take a while.

                2. Crazy is a perception. Some things are changed out of necessity. The people REALLY didn’t like dictatorship in the Middle East. So they rose up, but a lot of people lost their lives, no GAVE their lives, for freedom. I’m not ready to lay down my life right now, but if faced with tyranny–I don’t know.

                  Is it possible for you to put yourself in someone’s shoes, even for a moment? If so, I have hope for you.

                  I met a nice cop once, no two. I dated a retired LAPD guy years ago, and found out a lot of things about the work, a lot more than I ever imagined. Suffice it to say that while he was drunk, he would rant and rave about all kinds of things, a lot of it having to do with his former work.

  12. Is it possible that Quirk-Silva and Whitaker may have overstepped their bounds, from a legal standpoint in speaking out against the officers involved in the beating, asking chief Sellers to step down, etc.?

    According to the city attorney, ‘the LAW states that we can’t say anything concerning the case, etc.

    1. It’s possible. If it is, I’m sure you will hear something in terms of a lawsuit soon. Asking though might be ok. Demanding? I would think that might something that they could sue for. I’m sure we will see once things calm down even more and the lawsuits by employees start pouring in.

    2. Speak out? Why is asking that the cops involved in a killing be placed on paid administrative leave be overstepping any law?

      The police department should have done that the next day after they watched the video.

      The Three Blind Baboons should have fired Goodblimp and Sellers during week three for dereliction of duty and lying to the public.

      1. I agree. The whole thing REEKS of a coverup. For weeks they pretended NOTHING happened .There were SECRET injuries the officers had and there was SECRET stolen property that Kelly had. There was a SECRET phone call that came in. The officers were still on SECRET duty for a month. The DA began his SECRET investigation that SECRETLY started the next day. It took 70 days for 25 highly paid investigators to bring charges and determine what killed a man when the whole thing was caught on tape and witnessed by a mass of bystanders.

        The Veth Man case was a SECRET too as he SECRETLY jumped the officers and the DA SECRETLY ignored the video that would clear him of anywrong doing that was sent to the DA not in secret. The reports were written in SECRET with SECRET events that took place that WERE NOT ON THE VIDEO. Yeah right. Shall I go on?
        Hey gang I didnt just fall off the turnip truck. Maybe you guys did. Guess what? When the Kelly Thomas video gets out it wont be a SECRET anymore. GEEZ this sounds like a deodorant commercial.

    1. Of course it will get out. In trial in full view. You will see at least 3 versions. All blown up in big time zoom to see every action of every cop and also Kelly. It will be analyzed over and over second by second by the prosecution and defense many times. Professionals testifying over and over about every second and giving opinions from both sides. If you can get into the trial everyday you will learn a ton about laws, police policy, and the actions that night. That way if the not guilty comes, you will understand it much better. You already understand Guilty so no need to attend for that verdict. 🙂

  13. Let poor KT RIP. He has done more for Fullerton, than anybody else. We will wait for what comes out in the future. The video, who cares. We all know what happened. The question is, how do we move forward?

  14. As the trial gets closer, just watch them turn on each other. There is good and there is evil. They all want to be free and clear. They will turn on each other, for their own servival. Like dogs protecting the last piece of meat.They convict each other. Isn’t that how is goes R.I.?

    1. Just depends. Like I said, there are two main players. The others responded to the call for help. They say what they recall as they ran to the incident. No real reason for anyone to turn on each other when there isn’t much to turn on.

      It will come down to the frame by frame, sound bite by sound bite, of each and every second from the call, to response, to actions by every person on each side. It’s not as cut and dry as you think.

      The Ivory Webb case was the same. Everyone said guilty. No doubt. Shot him on purpose. Not doing anything wrong, putting hands up, shot him. But when you blew up the video, frame by frame, and laid out each and every move, jury said based on training and experience, laws and policy, it was a good shooting.

      I think this analysis could lead to the same result. Maybe not. I don’t think there will be any turning on anyone. Just a long extended trial and it will be tough for the jury.

      1. Cops are human. They will turn on each other. Just as any human trying to stay free. Criminals always turn on each other, “when caught”. I have seen it happen. Yes, they were bad guys, but these cops are bad guys too. Training, experience, laws, policy still criminals at the end of the story. And I agree it will be tough on the jury. I feel the DA will be soft, they will not do the job right, because they are cops. Sad…..

  15. That is how the Rodney King trial played out. No one contested that the police were making a legitimate arrest. The charges were that excessive force was used to take Mr. King into custody. Therefore, the defense had to go frame by frame trying to justify every blow.

    We know Kelly was thrashing his head around trying to breathe and stay alive. In this case, the district attorney is contending that Kelly had a right to resist and that Ramos had a responsibility to inform officers arriving later that Kelly was lawfully resisting him based on his unwarranted aggression towards Kelly. If that is proven, every blow to Kelly became Ramos’ responsibility. Only Cicinelli is charged with excessive force. If Kelly was lying there motionless and receiving blows to his face, a frame by frame analysis isn’t going to help Cicinelli’s defense.

    The initial complaint was that a homeless man was looking inside cars and pulling on door handles. In a public area frequented by the homeless, that is a very vague description. It is like saying a tall guy was pulling on car handles. Could Ramos go up to the tallest guy he saw and demand to look through his backpack? Unless the tall guy was darting through the parking lot or had a trail of speaker wires dragging behind him, the police ought not forcibly detain him and search his personal effects. Without probable cause, they can only ask the individual to cooperate. According to the DA, Kelly gave them permission to rifle through his backpack. He was under no obligation, however, to sit on a curb enduring escalating threats of physical violence.

    As long as we are making assertions, I assert that Kelly never pulled on even one car door handle that day. He really was just a guy sitting on a bench minding his own business.

    1. You can tell they’re afraid of the video by how hard they try to make us believe everything is going to prove the other 4 cops were just doing their job.

        I don’t even think you can name one valid reason for probable cause to detain Kelly.

        1. You won’t believe anything until trial. I’ll put it this way. If someone calls in to the police and says there is a suspicious subject in a parking lot looking into cars and I arrive and see someone that I feel matches that call, I have every right to detain that person to investigate. In the trial, they will have the caller testify as to what they saw, and you will see it was Kelly Thomas they called about. The prosecution and defense will have all day to ask questions about conspiracy, a coverup, etc and in the end the world will see that the caller and the contact was legal and legitimate. Until then, there is no point in arguing what we think happened.

            So you know this for an absolute fact? Then obviously you have been getting inside information. Why was this not publicly released to support the claim of probable cause to detain and search Kelly Thomas? The lack of information makes the department look secretive and distrustful.

          2. You would have been pretty busy rounding up homeless individuals for detention. On Tuesday evenings the nearby First Lutheran Church of Fullerton provides a meal for the homeless. As we’ve seen through witnesses that have come forward, there were many homeless in the transit area. According to the DA’s investigation, ‘On July 5, 2011, at 8:23 p.m., FPD Dispatch received a call reporting a “homeless” man looking in car windows and pulling on handles of parked cars in the FTC parking lot.’ If that was the actual wording, why did FPD feel it was necessary to embellish that description adding the word “shirtless” as reported here and elsewhere? Indeed, if the dispatcher specified that a shirtless, homeless was involved, then that is a different story. Perhaps that is why no one has questioned probable cause issue much.

            I am just curious why the DA went to great lengths to mention that Kelly specifically gave them permission to search his backpack. If the officers were fully convinced they had probable cause, would they really need Kelly’s permission to search his pack?

            Supposedly, Wolfe took the backpack behind a vehicle to search it and found a suspicious letter (there is more to that story as well). That may have been construed as probable cause. Since Wolfe was out of earshot, Ramos would have been unaware of that. Why would he already have been bullying a cooperative Kelly?

            As far as these issues coming out at trial, that is doubtful. The district attorney is not interested in expanding his investigation outside of a narrowly defined box for sure. The feds, on the other hand, may take a different approach. According to Ron Thomas, three officers may face civil rights violations.

            1. The police claim the call stated Kelly was trying to get into locked cars, but sources close to the investigation say the call came from a Slidebar manager who complained that Kelly was glaring at the customers.

              Witness who were on the bus said he was minding his own business, not trying to break into cars and not glaring at customers.

              The video will hopefully prove who is lying. One thing is certain, no police had broken bones, and Kelly Thomas was not carrying stolen goods. So right off the bat the police version of events is unbelievable. They have every motive to lie to investigators. I’d sooner believe a psychotic homeless transient’s word over anything Fullerton police claim.

          3. I believe that the officers had just cause to stop and question Kelly, as a couple of the workers from the bar posted on the OCR blog that they called and said he was looking into cars to get officers out there right away, even though they didn’t see Kelly doing anything with the cars, otherwise they said it would have taken a long time to get someone out there. They might have even mentioned Kelly by name, so I don’t fault the officers for questioning Kelly. They didn’t want a homeless person out front because it was bad for business and they wanted him gone from the front ASAP.

            It’s what happened after they started questioning Kelly and how he was treated that was wrong.

            One of the bar employees felt terrible and thought it was all her fault about what happened to Kelly, but was only doing and saying what her boss told her to say. Should be interesting testimony in court.

            1. P.S. Even though all the posts were removed when the OCR went to facebook, , I printed those posts and still have it in case it’s needed to show the truth about the call made about car breakins or suspicious people on that night.

  16. “Protect and Serve” in Fullerton and justice system in Orange County is a disgrace to America. We have become police state with brutality everywhere. Cops are effective tools for the Riches, Elites, and corrupted politicans. Cops are mercenaries hired by the Estabishment, the WallSt FatCats, and the Powerful Elite to protect and preserve their grip on the government. While the cops are their tools to suppress social and political changes, the Federal and State government are their means to rob and enslave the working class. In effect, the Privileged Class uses the cops to do the ‘blue collar’ crime and the governments to do the ‘white collar’ crimes. Regardless of either methods, The Privileged Class are the true beneficiary of the status quo.
    Our Fullerton has been through a lot. Some caused by nature, some caused by human weakness, and some most recently caused by the police brutality and corruption without any regard for the human consequences. Betrayal is the worst possible feeling, especially from the people who suppose to “Protect and Serve.” It is not only one or two cops making mistakes, the entire gangs at Fullerton City Hall and police department. This is a painful and heartbreaking time. These crooks did this not just to Thomas Kelly but to Fullerton.
    Fullerton’s better off without these corrupted cops and politicans. We all are.
    Recall and boost these corrupted politicans and henchmen before it is too late.

      1. Tough. That’s an example of not having enough cops to deal with all the screaming morons. You have seen how LAPD has handled the situations. That’s the difference between having thousands of cops and billions of dollars, vs a few cops and no money. Yea, they could have called a tactical area mobilization and got 500 cops, but I guess they have to weigh their options. They can pepper spray the students and then kick them all out of school for good, or call in the mass troops and arrest them all. Tough times for sure.

          1. That is wonderful to see. One of the nice cops (LASD) I met 🙂 helped me chase a German Shepard out of a busy highway. I ran and she followed with her car dog until the dog was safe. She was so cool, and an animal lover! Cops are human too. I just wish some of them would admit it.

      I would think that some people in that bar should be arrested for filing a ficticious police report for their own gain and self serving motives. How many lives were ruined because of their actions?

I do believe that the officers were out there on good faith (they were responding to a call), , but the 4 cops will always have this on their records (which won’t look so good to be involved in this controversy), and the FBI has already said they are going to charge 3 officers (who else will be going to court? Wolfe?)

            Where is that FBI coming from? Ron? I find that odd. I heard Ron say that but has anyone else heard that from the FBI? The FBi normally doesn’t even start looking into anything until after the local trial and sometimes the civil portion. I just find it very odd they would say that or even have made any determination such as that. For one it would be all 5-6 and not just the other 3.

                1. The DA charged Ramos with murder because of the abuse of authority and the threats, I believe he didn’t think Kelly would die from the beatdown.                 1. The Feds told Ron that three were on the hook. The third must be Wolfe who watched the whole Ramos-Kelly interaction and actually struck the first blow.

                  If Gennaco does his job (iffy) he will nail the other three for violating Fullerton policy. Then McKinley will really have something to suck on. See, he’s proud of all of them – except “the two.”

          As I say, I printed the posts of the gal that said she was the caller (saying what her boss told her to say that wasn’t true), admitting she is tormented by her actions because Kelly lost his life.

          I don’t know if this information is important for the FPD investigation, but it definitly is food for thought on the events of that night.

          1. I hear ya. The PD could care less at this point. It’s all the DA and the trial. She will be on the stand and the prosecution will have your printouts I’m sure. She will say what she saw and what she did. I still think the call might even be recorded and will be played. We will see. I think she will testify to exactly what she saw and I think she will identify Kelly as the person she called about.

            1. She said they had a inside number they were supposed to use when calling. There had been some reported car breakins recently in the area. I’m sure that’s part of the reason Ramos and Wolfe came in like gangbusters on the call.

              I may just email these posts to the DA and let him decide the credability issues, if any.

              1. Yea that will all be a good part of the trial to watch. The call to who the caller had talked to prior and what was said. To proving the first two responders had any knowledge of any possible arrangement. If none, then back to the facts of a call, caller on the stand, and the radio call, to the responses. Then down to the nitty gritty of frame by frame, second by second.

  18. BTW……what will it do to the probable cause of questioning and searching Kelly, when it comes out in court (and is proven), that the call about looking into cars was bogus?

    1. If the cops knew nothing about it being bogus, then the bogus call will mean nothing.

      I think as the caller goes on the stand, that will become moot when they explain what they say and why they called.

    The DA charged Ramos with murder because of the abuse of authority and the threats, I believe he didn’t think Kelly would die from the beatdown. I believe Cincinelli killed him with his frenzied attack. PTSD? …Maybe, , probably so…but a tragedy, none the less, no matter how you look at it…………
