Don Bankhead Spotted Awake at a Board Meeting!

On September 21 at 5:30 pm I showed up to the Municipal Water Board meeting because I got a tip that Don Bankhead was on the board and public comments could be made. I could not turn down this kind of opportunity so I drove down to Fountain Valley to attend the meeting. I stepped in and everyone was in business attire with notepads going about their business.The first thing I noticed was that Don seemed very different here then he did at city council meetings, he had a certain quality: he was jovial, he was talkative. He even went as far as to stay awake for the whole thing!  I turned my card in to speak a bit late but they let me anyway, however once I stepped up to the podium and began to speak the chairman’s sense of democratic freedom of speech made a complete 180.

I said plainly that I did not know much about water business but I did know something about leadership, I proceeded to tell them about Don’s disappointing silence and lack of leadership in his own town where he was being recalled. I also mentioned his attack on lawful citizens acting lawfully to try to recall him and him trying to stop them illegally. While people weren’t vocal I did notice that less were looking down at their notepads and up in interest.

Unfortunately my time was cut short, being allowed to speak for only a minute of my allotted three minutes. Apparently having a lethargic,incompetent, untrustworthy sham of a councilman on your own board, who’s only action was to sit on his hands and wait for permission to lead in the face of an emergency is not important business.

Also Bankhead was allowed to defend himself which he did by saying on record ” Today the district attorney has finally released  his uh, uh, opinions… believe me for any of you who know me it is very difficult to keep my mouth shut, … we sat there and did what the attorney told us to do. He’s criticizing because of that so I want him and everyone else to know my mouth is no longer shut… gentlemen like this here will have no reason or justification to make accusations.”

The chairmen did not give me anymore time but I did not leave until I informed the people that councilman McKinley, Councilwoman Silva, Councilman Whitaker, and The Big Kernel himself, Dick Jones had all made statements about the matter. Maybe next time Fullerton will vote for a leader who doesn’t need to ask for permission to…lead.

    To put this into perspective, I have a friend who is a Fountain Valley police officer. She is also a member of the state bar.

    How ridiculous would it be if her attorney business card said “police officer” on it?

Regardless of Bankhead’s moral standing (which is open to debate), why would he, or any other public official in Fullerton or this entire country truly give a shit if their city was gonna be sued? Since any settlement that is paid to the victim(s) is not coming from their own pockets—BUT OURS—the very people who actually pay their salaries and feed their families and demand that they speak up!!!

  8. I am a State of California licensed electrical contractor. I had to take a state exam as well as currently maintaining my license with state fees and ethical behavior. If I should run for office and become mayor, should I put “Mayor Moron-State Llcensed Electrical Contractor” ???

  9. Fun post. But the bigger picture is that the parasite Bankhead has been spending the past 20 years going to all these useless meetings and getting paid huge amounts of money for doing nothing (well, catching up on his beauty rest, maybe).

    The Water Board has all sorts of subcommittee meetings each month that Bankhead goes to and collects a $200 stipend for each one.

    Over the years he has probably collected hundreds of thousands of dollars and never voted “no” on anything.

      It doesn’t seem like that great of a gig.

      Yes, board members receive a stipend of $221/meeting up to ten meetings per month. But not all meetings are compensated. One member, Susan Hinman, attended 183 meeting and along with benefits was paid a total of $25,718, about $140 per meeting.

      The wife of one of this site’s favorite villains is listed though. Linda Ackerman was paid $24,821 for 116 meetings, about $213/meeting.

    For years i have heard rumblings of a secret society still existing in Fullerton.

      Lets just say, a large portion of the rich arent rich there because they’re self made. Tax payer money has been and continues to be a large contributing factor to wealth in Orange County.

    Orange County District Attorney Tony Rackauckas said at a news conference last week that Ramos initiated the violence without provocation and that a surveillance video showed Thomas to be acting in “self-defense, in pain, and in panic.”

    But Schwartz said officers used reasonable force to deal with a “combative, violent suspect” who fought with them, kicked, flailed and tried to grab the Taser from his client’s hand.

    “As an officer, you can’t just get up and walk away because the suspect refuses to be handcuffed and fights with you,” he said.

    Schwartz also disputed the district attorney’s statement that Cicinelli hit Thomas eight times in the head and face with the front of the Taser. He said his client only struck him when the homeless man grabbed the hand holding the Taser at least twice. “The Taser was falling out of his hand,” said Schwartz, who said he’s watched the video.

    Susan Kang Schroeder, the district attorney’s chief of staff, said the video shows Cicinelli struck the homeless man with the Taser before Thomas grabbed for it, and then struck him at least seven more times.

    Schwartz also said that Rackauckas misstated elements of the chronology of events in the video and the threatening words Ramos made to Thomas, which formed the crux of prosecutors’ rationale for the murder charge against the veteran cop.

    The full quote, Schwartz said, was: “See these fists? They’re getting ready to f- you up if you don’t do what I say.”

    1. It’s kinda funny because there’s only 2 slight differences here:

      1) instead of Ramos saying, “see these fists? They’re getting ready to fuck you up.” and then Kelly saying, “start punching, dude. Then Ramos saying, “if you don’t start listening.” KT, “that sucks.”
      It now says that Ramos says, “see these fists? They’re getting ready to f- you up if you don’t do what I say.”

      Which is pretty much exactly the same thing, just in a different order that means the same thing.

      Oh and they threw in a notice that Kelly got one momentary chance where he *TRIED* to defend himself against getting his face beat in with the taser. He didn’t even get it in his hands and then got beat 7 more times after with it.

      All this, which in turn doesn’t change anything. They just want you to think it does. Gotta love the lawyer spin. Lol.

      The DA submitted a crappy case full of holes to absolve himself of responsibly and to quiet down protesters.

      The DA want their hands clean, they want to say “Hey! We charged them. Don’t blame us. Blame the jury for not convicting them”.

      They’re not going to work with Garo Mardirossia to go over additional evidence, they are not going to add additional charges, they are not going to call all of their witnesses and they have no interest in the medical reports released by Ron Thomas.

      I’ll add that even the timeline in their press release was all screwed up.

    Can you imagine waking up every day making a career out of dispensing lies and outrageous statements such as this? I would be very, very tempted to spit in this man’s face if I ever came across him.

    1. He’s Just the kind of lawyer any of the rest of us would want if we found oursleves in the same position as his client.

      Two years ago I was in a head-on traffic accident. I was seriously injured and will never recover completely. I can function and have a good life, but no more physical stuff. Skydiving, scuba diving, weight lifiting, even bicycling is out.

      I called a lawyer I knew and asked him for a referral since personal injury was not his line of work (He was an IP guy.), and he introduced me to another attorney in his office.

      All the evidence was in. The other driver was 100% in the wrong. He said so. The police said so, and so did witnesses. I didn’t like his attorney. He in effect called me a liar, a cheat and that he thought I deliberately staged the accident, anything and everything to do his best to defend his client. That was his job.

      I’d never met a pitbull in a suit before, but thats what my mild mannered attorney, or so I thought, turned into. He was out to win. The court insisted that we go to mediation before having a trial.

      I sat next to my guy in mediation and from the moment he opened his mouth, it was like he had a leather whip with steel tipped flanges on the end, and one after another he whipped strips of skin, off the other attorney from head to toe and down to the bone. Metaphorically there was blood everywhere.

      When he was in action he scared even me, and he was MY attorney.

      The damages were in the hundreds of thousands for medical care, ambulance transportaion and ongoing future care. My guy wanted to, and he was correct to want to, put the other guy out on the street. He wanted to take his home, retirement funds, and anything and everything that contained or could be converted from equity to cash, and he was well on his way to getting it all.

      I’m not perfect. I’ll be the first to admit it. My attorney told me what he wanted to do, and I being a layman in matters like this was willing to just go along with it, initially.

      I know I don’t, and can’t, make objective decisions all the time, especially when I’m in the center of the whirlwind. I try very very hard to surround myself with good people. When ‘things’ happen and my moral and ethical compasses become confused, I seek these people out for their counsel.

      I sign the paychecks, but none of the people who work for me care about that. I can’t pay them as much as I think they are worth, but they get paid before I do, everytime. I asked them why they even work for me. They said it was because when the chips are down I do the right thing, even when I don’t want to. When they paid me that compliment I almost cried.

      We had the discussion of what to do. I was in the hole for a lot of money, but what we decided was that we neded to put a figure on what was owed, what would be needed to put things back the way they were, and a little something for all the trouble to make it right. We acknowledged it WAS an accident and it was not right to destroy someone financially for it.

      (Please don’t read into this that I think anything that happened to Kelly was an accident.).

      My lawyer was taking about a high 7 figure settltment. My kitchen cabinet and I came up with a much lower figure, mid six figures, and when my attorney was metaphorically in the middle of breaking the bones of the other attorney, and when he (to my great surprise), in less than a couple of minutes in mediation got the other attorney up to the figure we had discussed, I held up my hand and told him to stop. He didn’t like that, but I was the client and therefore the one that got to make the decision.

      The other driver lost some skin. He didn’t like it at all, but angry as he was, when the figures were put to him and his own attorney told him it was a fair settlement, and that it would be worse if we went to court, he agreed.

      This was a conflict between two people (No. I’m not comparing any of this to Kelly’s situation.), and what was finally done was done with the help of my friends and a really nasty attorney (If he’s not your attorney, that is.).

      It was decided to go for compensation, not revenge.

      I did the right thing, BUT there’s not a day goes by I don’t dream about all the money I could have had if I had just sat back and kept my big f’ing mouth shut.

      Doing the right thing can be a real pi**er at times.

      Do I think there is corruption in Fullerton? Yes.
      Does there need to be punishment? Yes.
      Do I know as best as one can who is guilty and who is not, and how much guilt each should bear? No. I don’t have all the evidence yet.

      I thank whatever diety we all look to in times of trouble and give thanks that I don’t have to make the decisions that are going to be made in this case.

      The lives of these officers are over, ruined, and I want them to have the same pit bulls sitting next to them that I had. Nothing less will guarantee due process. Lawyers fight for us because we can’t negotiate the legal system as it is. by ourselves.

      Give them their due process.

      P. S. I even had an honest lawyer. Can you beleive that? I asked him to take the case on contingency. That way he would received between 35-40% of the settlement. He said, no. He told me it would cost me less if I paid him by the hour. I was wary of that statement. When all was said and done and I compared the figures, I paid him 75% less than he could have had. Go figure.

        If I ever knock out an old lady then take her purse, I want him as a lawyer.

        If I ever whip is out on a crowded playground, I want him as a lawyer.

        If I ever grab a stranger’s butt in a supermarket, I want him as a lawyer.

        The point is if I ever “find” myself in trouble like Kelly’s face “found” itself bouncing off the sidewalk, I want a lawyer like Michael Schwartz.

        He is a pitbull and will try to try to get me off no matter the circumstances and this is what we need.

  17. Defense lawyers are getting the bad rap here. They go with whatever their client tells them. I am sure that anyone here on the blogs would certainly want such a vigorous defense if you were accused of a crime. With some LEO’s out there arresting some for BS reasons, it is just time before some of us will need defense attorneys such as these.
    Thank God for the judicial system; though not perfect, but the only one we’ve got.

    1. And you know as well as I do that these cops feel they are innocent and this trial is going to be long and nasty. Swartz is the best in the business. It will be very hard to get a conviction. DA is going to have to present a flawless case. You are getting a feel for the defense already. Felon, violently resisting, grabbing the taser, and everything else. Mom and Grandma will be called to testify on the felony and restraining order. Going to be an interesting trial.

      1. I believe this is just like a DUI… it is not the first time they broke the law while wearing a badge and falsifying charges, it is just the first time they were caught….. well Hampton seems to have really stepped in it though.

      2. I agree it going to be a tough, uphill battle for the DA, but let’s face it, when defense attorneys can’t refute the evidence the standard response is to attack the victim. That’s all that is going on here at this stage, and it will continue through the trial. In my opinion though there are more important matters the jury will consider.

        Left out of the discussions is this: Ramos tried to de-escalate and soften his threat. Here’s the exchange:

        Ramos: Now, see my fists?
        Thomas: Yeah. What about them?
        Ramos: They are getting ready to f*** you up.
        Thomas: Start punching, dude.
        Ramos: If you don’t f****** start listening.
        Thomas: That sucks.
        Ramos: Yeah.

        After Thomas challenged Ramos to start punching, Ramos backed off, qualifying his threat with “if you don’t start listening.” Most sane people would respond “okay, sorry, I’m listening, what do you want me to do?” And no doubt Barnett will bring this out in Ramos’ defense. But Kelly wasn’t sane, he was a mentally ill (paranoid?) Schizophrenic.

        If I were prosecuting this case, I would let Barnett attack the victim for his past history of violence all he wants, and I would acknowledge that history to the jury because it could be seen as bolstering what should be a central theme for the DA: Kelly was not a normal human being, so his response to Ramos’ threat and invitation to de-escalate was not normal either.

        Now the case hinges upon Ramos’ training and whether or not he knew his threat violated departmental policy. A policy put in place not just to get cops to be respectful and nice, but also because not everybody a cop comes into contact with is going to be mentally stable and respond ‘normally’ when threatened. The DA laid the groundwork for this part of the case when he spoke of the long lead-up to the threat, of Thomas’ apparent cognitive issues and difficulty understanding and following Ramos’ orders. It would seem that if you’re dealing with somebody who’s not ‘all there,’ the last thing you want to do is threaten ‘em.

        So it will be for the jury to decide, did Ramos simply make a terrible mistake in violating policy and misreading Thomas and his potential responses, or did he just not give a fuck, and was more than happy to have an excuse to beat the living daylights out of Kelly? If they decide it was the latter, Ramos will be convicted of murder and probably manslaughter too, if the former it will be involuntary manslaughter only. Either way, I see Ramos being sentenced to a significant term in state prison.

        Ciccinelli’s case looks like slam dunk to me. It will be impossible to find justification for tasing the shit out of the victim until the Taser’s batteries ran out, then following up with beating the silent and non-responsive Thomas with the dead weapon 11 times across the face. Cicci could get the maximum.

    father of the homeless man prosecutors say was beaten to death by Fullerton police officers — now says he has been targeted and harassed by police in his home city of Cypress.

    “I have been harassed by my own city’s police department,” Ron said in a news conference Monday. “They have this code of silence in Cypress also and I’m not going to put up with it.”

    Cypress Police Chief Jackie Gomez-Whitely said the news “shocked and surprised her.”

    Ron began his movement by telling all of us he was an arrest and control instructor with the Orange County Sheriff’s Department.

    Ron attended the OCSD Academy in the 1980s, squeeked by and was soon fired for incompitancy less than 2 months after his training.

Come on Saturday and meet him. Like I said, he doesn’t bite and he won’t threaten you with anything other than some sincere peaceful conversation. You may leave with a different set of facts or possibly you don’t want those facts. Either way, other than talking to him directly, you cannot make judgements about his past careers without looking him straight in the eye and talking with him man to man.

      I can appreciate what you said. In reponse to my comment with 9c1, I’m sure he is a decent person. Although these blogs are a forum for us to speak our minds, I don’t think having a conversation with 9c1 about his employment would be productive, or even useful given that the rallies are a push for justice – however right or wrong it is.

      9c1’s comments have given me some doubt as to his law enforcement involvement.

      I do think, however, that by telling your fellow bloggers you are a retired police officer, it would assist with degrading police, in general, even further. In this particular forum 9c1saying he is a retired cop certainly gives him more attention.

      Yes, law enforcement is a tight community and not a gang of thugs. There are a small percentage of police who somehow make it through a background and psychological exam, and those police are eventually fired.

    1. This video is an excellent example why police have more difficulty dealing with “unruley citizens”. It clearly shows here why police use force. This was not a beating and the knuckleheads filming this created the situation. NOT THE POLICE..

      Police can detain for reasonable suspicion. Police have the right to use force if someone resists them (ie; not following simple directions and standing from a sitting position, in this case)

      getting up from a sitting position when told to sit is a form of resistence and defiance and police have the right to use force necessary to prevent escape when a lawful detention exists.

    I had an issue with your post regarding “Police making arrests for BS reasons”. That’s not something you would say if you have any faith or belief in the Law Enforcement Code of Ethics. You seem to have some resentment towards police for some reason. You are letting the actions of 2,4,5, or 6 officers remove you from reality.

    One more thing. I do have faith in the system, however, SOME LEO’s do not have any ethics or morals. Somehow, in the process, they slipped through, and society is the one who pays the price. They are the ones who find something to arrest innocent people on, and afterwards, they are able to look themselves in the mirror, and sleep like a baby. Now tell me, do you want that kind of officer patrolling YOUR neighborhood? I would be interested in your answer.

    Perhaps you can further your thought on “Company Policy” on hiding and obfuscating facts. What official/unofficial policy are you referring to?

    My department has no such policy and in my 20 years with the agency, we have never engaged in such practice. You are making a blanket statement sir.

    If you see the need for such a personal quest then maybe you should bring to light all of your department’s (LASO or not) dirty laundry and make it public.

    If you say that your career forced you to remain silent until retirement, then your core values should be in question. You should never have remained with a department that forced you to remain silient of any wrong doing.

    All I am saying, is that I am frustrated to see SOME LEO’s disregard policy and procedures that are set in stone. When they do, they leave a trail that builds as they get braver in their endeavors. What I rail against, and you should also, is when Upper Management allows them to operate with no checks and balances, or expectations of punishment. That’s what breeds the Ramos’ and the Cicinelli’s.
    I am not saying that if the situation requires it, you do not act for fear of lawsuit or the such; you do what you have to do to save your life, that of your partner, and that of the public.

      I agree that you are being drawn into an argument where no Winner emerges, only Losers.

      Hopefully Allen will see fit to do what I think is right, put a face to the internet name. You guys should meet, discuss the situation in a respectful, friendly manner and go about your ways as citizens afterwards. If you can agree on anything great……..if you disagree, at least you had friendly dialogue. We can as Americans agree to disagree in a friendly manner.

      I would keep the conversation, as you have, on a macro issue basis as opposed to micro issue basis which is not appropriate on this venue. You know exactly what you experienced, how it affected you and that you really shouldn’t aire specific cases on this board. You are a stand up guy and I respect you for that.

      Your stance and opinions are very odd. I think that’s why some people and cops react the way they do to your comments. The reasoning for your opinions is based on something. I’m not sure what it is but I still believe it’s because you realized law enforcement wasn’t for you, you couldn’t deal with the force part of LE, or you weren’t promoted and are angry due to that. I could be wrong but I have never heard someone like you in my career, retired, fired, medically retired, or active. There is more to your stance and you know that.

      If you really believe there is rampant and consistent abuse in LE, you must have tried to do something about it. You must have reported all of these cases over and over and over to your bosses. You couldn’t make a change with all of this reporting?

      I have never known a boss in over 20 years that allowed violations of policy or law. Not one. You are saying that you knew bosses, Sergeant up to Chief, that knew of policy violations and law violations, and allowed it and condoned it? Things they actually saw and just let it go?

      I’ve seen discipline over and over through the years. Discipline seemed to work each time, and when it didn’t, those people were fired. As you might know, getting terminations to stick are hard, but that’s not in the hands of the city or county, that’s an arbitrators decision.

      I know policing is not a perfect science. It never will be. It involves humans on both sides, and we will have cops that abuse, steal, make bad decisions, have off duty incidents, and everything else. But I have also seen the process work to get them out when violations are found. I’ve never seen the things you claim be tolerated and accepted by brass.

      You use the names Ramos and Cicinelli as examples. Do you have numerous other incidents with these officers that shows they have a continual pattern of abuse? You say it as if you do, and that these incidents were intentionally covered up and not punished. I have only heard of this incident with these two, and the Mam incident with a few other officers. I know this blog claims mass corruption and coverup, but in terms of facts I haven’t seen it. It may be true, and if it is Gennaco will find it, but until then I’m wondering what you know as fact.

      Yes, I’ve heard about a few cases with an iPad, sex, and something else but do we know those were also covered up and dismissed?

      You know as well as I do that mentally I’ll people can be one of the most dangerous group of people out there. You also know that making a split second decision to use force to prevent injury or death to yourself or a citizen, does not allow you to evaluate mental status. Reasonable force will always be used.

      Anyways, I know you preach all you want is good cops top to bottom. I just sense you have something against good cops too. I think Fullerton will be cleaned up in the end, if problems are actually found. I don’t think this incident will change policing in general at all.

      I know I’m just a troll here and that’s solely because I choose to look at the big picture, and the reality of what will happen. The DA’s explanation of cops responding to a call for assistance is the key for the other cops. That’s why only two will ever be charged. The only one in question is the one actually there when it happened, but clearly what he did in the incident didn’t justify charges. If I respond to a fight call and officer needing help, I am going to respond, not ask questions, and do what I need to do to get the aggressor in custody. If something illegal happened prior to that causing the fight, that’s not my fault because I don’t have that knowledge. If I jump out of my car, and see a struggle still going on, the suspect not in cuffs, blood all over, and legs kicking and flailing, I’m going to remove my baton and strike the legs as hard as I can to gain compliance. If I did that in this incident, I wouldn’t be charged. I have also not seen any evidence in this case to show officers didn’t report their use of force to supervisors. People have opinions about what should have been done in the investigation, bit if policy was followed, no wrong doing will be found.

      Good luck with your cause. I’m a realist when it comes to policing and the community. Laws are laws. If people break them, they should be punished. Policing is not an exact science, never will be. If you run force and arrest incident by 10 people, it’s entirely possible the 10 citizens will give you 10 different answers. That alone is why policing is an ongoing project in educating the community of why and how things are done.

        1. Not sure what your comment or question actually means. Yes, members of the community are punished for their crimes everyday. Yes, I arrest members of the community. Yes, I am a member of the community.

      2. My grandfather was a retired LAPD. He was out in gear during the Watts riots. He was proud to be a police officer, but growing up he always reminded me over and over again to always address officers with respect, yes sir, no sir, etc. His reasoning, and I will say it in EXACTLY his words, “They deserve respect for what they do, but there are guys on the force who are looking for any excuse to whoop your ass”. I understand things were a little bit different back in the 60’s, but that doesn’t mean things have changed completely.

    I literally could see tears start to form in his eyes. Does that sound like something that would happen to the bloodthirsty leech you make him out to be?
