Let us flash back to the early stages of the FPD’s attempted coverup of the Kelly Thomas killing. Here’s the FPD’s version of the story, as passed along from Sergeant Andrew Goodrich via the uncurious OC Register.
This story came out the day after the beating, even before Kelly was taken off life support, and the dissimulation was already well underway. Months would pass before the DA’s revelation that an innocent man had been beaten to death under color of authority.
And speaking of color I have helpfully highlighted in bold red statements and assertions from Andrew Goodrich that were flat-out lies.

The 37-year-old man, believed to be a transient, is suspected of auto burglary, police said.

FULLERTON – A man suspected of trying to burglarized cars remains hospitalized with life-threatening injuries after police say he fought with officers trying to search him.
Authorities say Kelly Thomas, 37, injured several officers who tried to detain him Tuesday night, while family members allege that police used excessive force in taking him into custody.
About 8:30 p.m. Tuesday, officers went to investigate reports of a man trying to burglarize cars in a parking lot next to the bus deport in the 100 block of South Pomona Avenue, Fullerton police Sgt. Andrew Goodrich said.
Officers spotted a shirtless man with a beard, shorts and a backpack who they suspected of being involved in the attempted burglaries, Goodrich said.
The man began to fight officers as they tried to search him, Goodrich said.
“We don’t know why he was so combative and resistant to the officers, but it took upwards of five to six officers to subdue him,” Goodrich said.
During the scuffle, Thomas suffered head and neck injuries and was taken to a hospital, where he was listed in critical condition, Goodrich said.
Two officers suffered moderate injuries during the fight, including broken bones. They were treated at a hospital and released.
It was unclear if the officers used non-lethal weapons to subdue Thomas.
“According to his family, he has a history of mental illness,” Goodrich said, adding that he is a transient in Fullerton and surrounding cities.
Ron Thomas, Kelly Thomas’ father, said his son was homeless by choice and had been diagnosed with schizophrenia.
“When (police) rolled up, he was by a vehicle. They wanted to search his backpack, and he turned on them,” Ron Thomas said.
Thomas contended that his son’s injuries were the result of an “extreme use of force” by officers, who he believes “slammed” his son’s head and face into the ground. Based on his son’s injuries, Ron Thomas believes officers “took his legs out from under him while pushing him downward.”
“They have all the training, they have the weapons, they have the Tasers, and he is 160 pounds, barehanded,” Thomas said.
Thomas is on life-support, his father said, with doctors telling the family that he likely suffered brain damage.
“I can understand why a father would say that, but we are going to do a thorough investigation,” Goodrich said of Thomas’ comments. “Some of our officers also went to the hospital due to injuries they suffered. Sometimes when we take people into custody who don’t want to go into custody, we have to use force. It is never the preferred way of doing things.”
Goodrich said police are conducting a criminal investigation into the attempted burglaries, as well as an internal investigation into the officers’ actions.
“It’s always unfortunate when someone is injured, and we do what we can to minimize injuries whenever possible,” Goodrich said.
So did Goodrich ever suffer any consequences for all this unadulterated bullshit? Of course not, for this is Fullerton government where there is no accountability for malfeasance, and nobody in officialdom finds it objectionable that the official City spokesman has not even a passing familiarity with the truth. Of course it could be argued that Goodrich was just a useful idiot in the service of a cover up of an event about which he was largely misinformed by his fellow union members or their (and his superiors)
Either way the whole thing stinks. And any way you slice it looks like a cover up.

What a great read. I’d like to be overly pedantic and look at this lie in particular:

Why did I choose this line? Goodrich apparently claimed it took UPWARDS of five to six officers. Apparently Goodrich is unaware (surprise!) that the word “upwards” indicates a number GREATER than those referenced. Given that there were only 6 police on the scene, the idea that it took MORE than 6 officers is either 1) a flat out lie or 2) a great indicator of Goodrich’s lack-of-a-grasp on the English language

More than five or six men were needed because Kelly wouldn’t be totally subdued until he was completely besmirched in the eyes of people as a dangerous, drug-crazed addict perpetrating egregious crimes and thus deserving of brutal treatment. That would require a coordinated team effort, and the brass had already memorized the winning playbook for doing that. In this example, controlling the facts surrounding Kelly’s story during the initial press release was critical. The hope was that newspaper readers would peruse the story, roll their eyes and turn the page. That almost happened
One wonders whether whatever was cooked up in that collaborative report-writing marathon will form the basis for the defense of the officers charged. If they went down the crazed PCP addict path and were expecting a little help from the coroner, they have an uphill battle now. Massive public scrutiny may have taken away much of their playbook.
There was an FPD investigation of sorts. Someone had to scoop up cellphones and intimidate Bunny into surrendering her film. Someone had to supply fresh coffee and erasers for the lengthy, video-enhanced report round table. Someone had to dig through old mug shots to find the most threatening image of Kelly possible for release to the Register. Someone had to call the individual who tossed old mail in the trash and coax him to say it was stolen. It must have seemed irrelevant that the wrinkled parcel may have had spent gum or a discarded popsicle stick attached. Anyway, those investigative man-hours really add up.
Did Wolfe really mangle that letter in Kelly’s backpack as probable cause at the scene, or was that plan concocted after the fact? We may never know. The district attorney who was adamant that releasing the video would taint witnesses’ perception of events suddenly had to embrace the concept when it was leaked to the public that the officers involved had done exactly that while drafting and amending their reports. Now, he’ll likely work within the framework of those reports as much as possible. Clearly, the DA wants to limit culpability within the Police department to a couple bad apples. The problem with that approach is that people know that bad apples don’t suddenly spoil overnight.
This particular spokesman’s commentary seemed to vary depending on the interviewer. He was boisterous, glib and free-wheeling when speaking to the Register. He was cautious and contrite when speaking to local televised reporters asking tough questions, and he completely refused to speak with the national news media at all.
As someone has said, FPD should have fallen on their sword immediately and taken the hit. The city would have maintained a modicum of confidence in leadership and been spared international ignominy. Instead, they made a gross miscalculation. They didn’t understand that there is an irresistible urge within most Americans to come to the aid of a scrawny, defenseless guy when he is being flattened by the town bully.
“We did what? Oh shit. We need to get out in front of this one immediately. Just make something up and hand it to your tool at the Register.”

Also, I am pleased to know that the FBI is going to press charges on 3 of the individuals involved as soon as the DA’s case is concluded. Federal prison is not a good place to be if you are a convicted cop.

Kellys recordings pleading for his life will be to the killers like a pedophile or serial killer reliving his happiest moments with a victims trinkets. It would have certainly figured in the ferociousness of the murder as crying for mercy from a bully just makes their weinies hard. bet he smiles in court when he hears it.

What would I gain by lying to you about such a serious matter, which, by the way, potentially has ramifications for every one of us. Also, one would have to be deaf, dumb, and blind not to realize that there were civil rights violations in the Kelly Thomas murder. The cops in the Rodney King case were charged with civil rights violations and King was not even murdered!

What do Conrad Murray and Jay Cicinelli both have in common? Both exhibited reckless self serving behavior at the expense of a helpless fellow human being. Both are up with the same charges and claim innocence and both blame the victim for being the cause of the tragedy. The judge in the Murray trail recognized this and gave the maximum sentence. However ,despite the worse possible sentence he will be out in less than two years. Can any thing more be expected in the trial against Cicinelli, the real culprit who inflicted the fatal damage to Kelly.
Let’s see what kind of sentence he gets from federal judge!
LA County DA Steve Cooley is apparently considering some sort of motion to ensure that Conrad Murray serves the full four years (despite Lee Baca’s “half-time” sentence rules due to “overcrowding”); sounds like Baca is starting to be thrown under the bus…
& If memory serves, once the grip of control started to loosen as it became obvious this would not just go away, they then tried intimidation by sending FFFF a letter from FPOA lawyers threatening legal action for merely reporting the story… Perhaps admin can dig that one up again so no-one forgets the desperate length the ladies in blue were willing to go to keep this out of the spotlight.

The spin some would like to put on Kelly is he has this violent history that in some way is going to assist those charged with this crime. Right Reality Is?
Bringing up ones past is simply a deflection or attempt to deflect the real issues. If Kelly was alive and got onto the stand and said he has never been violent, THEN it’s time to challenge him, and he should and would be. BUT he is dead, so he can’t say that.
Ones past history in a case such as this is moot. There are no facts before the public that suggest Kelly did anything at the TIME to justify this use of force that clearly resulted in his death.
Are defense lawyers going to say, ” my client used this level of force because Mr.Thomas has a history of violence”?
They might. But even a rookie prosecutor will simply show the video to everyone and ask them if they see Kelly punching and kicking at anytime?
If Kelly simply attempted to get away from Ramos and his pals, because Kelly was scared he was going to get beat, then the attempted escape is also justified.
I’d say the putting on the gloves and the words I am going to F you up is justification all by itself.
Especially when you put Kelly’s mental health issues out there. If Ramos knew Kelly from the past, then one might suggest Ramos was screwing with Kelly’s mind knowing full well Kelly might “freak out”, and maybe Ramos was hoping he would to help justifie beating him. Some might call that the flip side of the coin.
We should all remember the DA telling us citizens may RESIST unlawful actions of the police.
Setting that aside, a person running from the police is not subject to a beating either. It happens a lot, but this one was way over the top.
Again if the video shows Kelly punching at or kicking those cops, then that is going to be a toss up, and I think a jury MIGHT side with the cops.
But if you start the fight as it appears Ramos did, good luck trying to justifie the end result.
IF NOT, then attempting to simply use Kelly’s past history of violence in hopes that it sways the jury, could easily back fire if that video doesn’t show Kelly being violent. VIOLENT being punching and kicking at the cops. Attempting to run is NOT a violent act.
Whoever the defense WHORE is, who gets up on the stand and attempts to explain that everything that happened is justified, when no violence can be shown on Kelly’s part, is just that A WHORE who is trying to make a buck or score points with some thugs wearing badges.
Let’s flip the coin here for a moment.
If Kelly’s past history of violence is open for discussion as Reality Is suggests, then Ramos and his pals and FPD’s past history of violence is also open for debate before the jury.
This we can talk smack about Kelly’s past history but our history is confidential is CRAP.
But we can all bet on one thing, FPD and the defense lawyers will want their cake and be able to eat it to. They will do their best to make Kelly the bad guy and argue FPD and it’s employees issues are a non-issue.
I should add that the prosecutors in this case should be seeking information from the files of those cops involved.
Information that might show THEY too have a history of violence or the propensity for violence.
Just in case the cops get on the stand and say I am not violent, or I am a great cop, when their NOT.

Yep. If they have a pattern, it will be known. It’s called Pitchess Motion to get that information. They are hard to get, but in this case they will be able to get it. It’s a separate hearing with a judge and he decides what of their files can be allowed for viewing.

Yes still on med leave. He will just retire or retire with partial medical. He’s gone for good. He was on his way out before this happened anyways. This just made it easy for him to leave. Right now the work comp system is paying for him.

We now know that their was ZERO internal investigation until Gennaco was hired. That may have been the most damning lie of all, proving a cover-up.

Now let’s be fair to Sergeant Good and all the other cops out there who honor the “code of silence”.
Sergeant Good did what he was instructed to do by his superiors. If he didn’t, he would be out of a job in short order. I bet you anything harrassed by others too.

I really feel compelled to disagree. I think Goodrich was just out there on his own, making stuff up and peddling it to Lou Fonsi, et al.
We now know that there was zero leadership or control in the FPD and I believe that Goodrich’s impulse was to immediately stonewall and lie.
The fact that nobody in the FPD or on the city council (exempt Whitaker) has shown any indication of unhappiness with Goodrich shouldn’t be taken to mean they were directing him. But they obviously like what he said and did. And that’s pretty disgusting.

All Sergeant Good can do now is write the checks to the lawyers and keep them focused, and fly under the radar before his ass is handed to him.
If we start to see an obvious weight loss in Sergeant Good, we will know the stress has taken it’s toll.

The Feds have made no decisions on anything and are only half way through. They won’t do anything until the criminal and civil cases are done.
Nothing will happen to GoodyRich. He’s not being investigated and will receive no discipline or charges.
Stay focused. It will be hard enough to win the criminal case and recall. Don’t start dreaming about things you are basing solely on far out guesses.

The civil case is going to be a slam dunk. How many victims of police brutality has Mardirossian deposed so far do you think? A clear pattern of excessive force, multiple civilian complaints filed with no action taken, culminating in a death. Chhh-ching.

I’ve always said educating citizens on the laws, policies, and how things are actually done and why are some of my best experiences and classes I’ve done.
What position in LE teaches citizens on policies, laws, etc. ?
Where and how is that done if a citizen wants to sign up?
The first place to start is a citizen’s academy at your local police department. Depending on the PD, some are very very good and informative. At least gives you an idea of how things are done, policies, and some hands on interaction with the special details, etc.

A defense motion to dismiss charges against six former Bell city leaders was rejected by a judge Thursday during a court hearing.
Ex-city council members Teresa Jacobo, George Mirabal, Luis Artiga, George Cole and Victor Bello and two other city officials were charged last September with fraud and the misappropriation of roughly $5.5 million in public funds.
Through a motion, their attorneys sought to dismiss the charges based on a 2005 ballot measure that the defense said charter cities from state laws restricting council member salaries.
However, the court stated during its August decision that prosecutors in public corruption cases must prove defendants knew they were breaking the law, or were criminally negligent in not knowing.
Superior Court Judge Kathleen Kennedy wrote in her ruling there was “ample probable cause” to believe the former Bell officials knew they were aware they broke the law.

The six former council members are scheduled to stand trial with ex-City Administrator Robert Rizzo and his former assistant Angela Spaccia February 2.
Rizzo is charged has the most felony counts of those involved in the fraud scandal. Of the 53 counts against him, six are for falsification of public records by an official custodian and three are for conflict of interest.

Concerning the Rizzo charges, I was up in Seattle at the track there and Rizzo had over 25 horses in training at the track! That made him one of the largest owners up there. The training and exercise fees and feed and vet average $2,500 per month. So Rizzo needed to come up with CASH $750,000 on his $800,000 per year salary just to cover the horse expenses, not including the cost to buy them! Rizzo will be spending quite a spell in state prison.
Unless I misunderstood the DA in his statements to the press, he stated that the audio and camera at the bus terminal verified that Ramos was putting on the gloves and telling Kelly he was going to F him up before Kelly did ANYTHING wrong. Like running.

I understand Seer2Some. What I was saying that I can tell you that 150 people did not see this incident, and 150 people did not say that he was brutalized. I’m sure that the 10 that did see the actual use of force, did say that he was brutalized. That wouldn’t surprise me a bit. But the other 140 witnesses didn’t see that part, they saw the contact, the cop cars arriving, prior contacts with the officers, homeless people walking around, etc.
