FPD Alerts Public On Sex Offender
Well, here’s the information provided by Andrew Goodrich & Co. about some dude who needs to register as a sex offender for the rest of his life.
Everybody’s supposed to be scared. At least this loser did his time.
Too bad Pat KcKinley’s boys never bothered to alert the women of Fullerton that a serial molester of women, Albert Rincon was prowling the streets of Fullerton preying upon precisely those women McKinley would characterize as not credible. See, Rincon was one of Fullerton’e Finest. Really.
And he was actually put back on the streets after a little sensitivity training.
But Antionne Dennell doesn’t wear a badge, therefore he is not credible and a REAL dangerous sex offender.
Albert Rincon wore a badge and Pat McKinley hired him, therefore he is credible and NOT dangerous.

Because we have cops who have committed heinous crimes, it does not diminish the significance or reality of the fact that non-cops also commit such crimes. It strikes me as unproductive to discredit even good moves made by the police moving forward as a result bad behavior in the past. Let’s be hyper-critical of the bad actions…not the good ones.

They’re being hypocrites. Here they’re warning the city about a sexual predator who they know where he lives and they have him under surveillance and he hasnt done anything since he’s been released. YET they have a repeat rapist by the name of Officer Albert Rincon on their payroll, they havent warned anyone about this guy, they havent told anyone if he’s still on patrol, on leave, etc AND to make things worse they’ve already settled with his victims.

More to your point, one would logically conclude from your comment that the mere act of the cops doing their job in this case was hypocritical and therefore the wrong thing to do. If that is not what you meant, then it is good news and I’m glad I pointed it out.
Agreed whole-heartedly, Chris, with your points on Hmm’s language and name calling choices, however, I believe the point he is trying to make is that FPD should have taken the same stance with Rincon as they do with any non-leo sex offender like Dennell.
I agree with that WG and the hypocrisy is worth pointing out. I think it would be more effective and beneficial to accompany the point with an acknowledgement that the right thing seems be taking place here. I assume that there are some cops on that force who are highly motivated to do the right thing…although I cannot forget the fact that none have had the courage to publicly condemn the wrong doing. Rincon wasn’t fired until THREE YEARS after his offenses were revealed.
And he wasn’t even fired for the original offenses. He did something else that we don’t even know about yet.

Should I feel good about the 3 year wait time? Well, think about this folks, Officer Cicinelli has lost his pay, Officer Ramos lost his pay and they have not been convicted nor has the city settled on damages yet. So it appears that its possible to fire these miscreants much more quickly than the case with Officer Rincon.
Now understand this: While Sellers is hiding on sick leave, who is in charge making these decisions? I believe it is not the Acting chief acting alone, but good ol Pat McPension trying to clean up after himself with his 3 dinosaur majority on city council. If not for the recall, Rincon would still be working and Ramos and Cicinelli would be on PAID administrative leave.
@Reality is – Are you referring to Chris Thompson’s post? “Rip’ing on everything (the PD) does in the past.” ? He was actually saying the opposite of what you are accusing him of. There remains much to be discontented about regarding the FPD, but each issue can be addressed as it comes up. We do need to correct FPD on it’s shortcomings, while acknowledging the positive actions as well.
As long as any City officials continue to act like this is their little fiefdom and we are all the ants they control without any recourse, then they are going to experience this site blasting them mercilessly.

I made it very clear that it was the right thing to do and they did their jobs as they’re supposed to do but they failed to take the same actions against Officer Albert Rincon which put the public at risk.

So, Chris explain why the Fullerton PD should not warn (or have warned) the public about Officer Albert Rincon who was accused of sexually assaulting 6 women while on duty.
Also explain why they should not release his photo to the public in the event that there are other victims out there.
Ummmmm. Not backing up the officer or the circumstances, but there is a huge difference between someone that is accused of doing something wrong and someone that has been convicted and served time for doing something. That’s the biggest difference I see in your comparison.

It is theft, plain and simple. “Reality Is” ( who posts on this site regularly states that he/she is a retired FPD, living on pension) , and clucks that he/she is happy as can be because “nobody can touch his pension”. Yes, current pensions will only be changed if Cal Pers goes broke, and the state has to make some of that missing money up. However, new hires can be under a new system. In addition, If a city goes bankrupt, ALL THE CONTRACTS are then up to judicial decision in bankruptcy court. So Fullerton better stay solvent and remember, they are a self insured city so their settlements come out of the city treasury (general fund).
As long as California continues with the great recession, public opinion is swaying against public employee unions – its a slow moving tide.

With the Madame Quirk-Silva as new mayor and some recent positive actions on the part of FPD, namely the apprehension and arrest of that parole who stabbed that cabbie, we should all feel at least a bit more optimistic about the direction of Fullerton’s leadership. I’m guessing where Fred was going on this was, given FPD’s history of trumped-up charges, false arrest, and perjury, it is hard to feel confident in the general integrity of the institution. We have no idea how many false arrests have been made, or how many languish in jail to this day because of false arrests and perjury.
It is sad when an institution of justice loses all credibility, but they have only themselves to blame.
Agree. That’s what I was saying. If you can’t look forward no matter what then the only answer is to go Sheriffs. You will have half the force go to the jails and other cities, and the remaining ones will look different in tan. The FPD responds to thousands of calls a year, made countless arrests and continued to perform their duties faithfully during the Kelly Thomas investigation.
In fact nothing has changed in how they police the community. They continue to conduct themselves in the same manner as always.
I guess my question to you and Chris Thompson is: What was the point of protesting in front of the police station, in city hall and demanding a recall?
They conducted an investigation in the beating and they fired the officers directly involved in Kelly’s death so …what more could you ask for or even want?

FF- Im not Chris Thompson but Im going to answer anyway, The point is/was regarding:
1- the protesting issue in front of the FPD-this is/was an expression/pressure and is an American right-to show the government that what they are doing and have been doing is not acceptable to the majority of the public -this is a freedom sacrifice that soldiers fight for. The FPD is a goverment establishment that use taxpayers money -the local Taco Bell is a private business
2-there was no investigation or firing of anyone until the public placed/showed pressure by the protesting, nor would there have been if no one cared enough to protest.
3-What more do I want? Politicians and government leaders that citizens pay for, to abide by the US constitution, to listen to the people and do their job the right way-and this does not entitle them to react like they are in an episode of Wild Kingdom or Rifleman or grab extra rights for themselves

Having said that, I think that the first 4 or 5 Saturdays had tremendous value to the cause and awareness. The diminishing returns kicked in hard when they kicked in, but the value has gone to good use. Thanks to the generosity of Tony and the hard work of dozens of people, we will be recalling these three council members who in my view, have done absolutely nothing for this city.

The coroner said how he died and the physicians said he died a different way. They will both be on trial. There is so many holes in this case it looks like swiss cheese.

The treating physicians were the first to see him when he was brought in…..and said he choked on his blood…
The Coroner saw his body after he had been on life support for a few days and the blood had been cleaned up…..

KHQ.COM – A jury has found Spokane police officer Karl Thompson guilty of using excessive force in the 2006 death of Otto Zehm in a north Spokane convenience store. Thompson was also found guilty of lying to investigators about the fatal confrontation. Thompson, 64, was the first officer at the scene the night police beat, hog-tied and tased Zehm inside a North Spokane Zip Trip in 2006.
Zehm died two days later. When he arrived at the gas station Thompson said he saw Zehm entering the store. Thompson said he was under the impression Zehm may have robbed two women in car using a nearby ATM. That information later proved to be false. In closing arguments on Monday Federal Prosecutors said “this case is about a police officer who chose to strike first and ask questions later.”
Victor Boutros, U.S. Department of Justice Trial Attorney, said Zehm posed no threat to anyone. Boutros said Zehm was a regular at the Zip Trip who would often times go just to get a soda. Boutros said, “With his dying words, he (Zehm) never understood why the defendant had beat him: ‘All I wanted was a Snickers.'” Prosecutors argued Thompson abused his badge as a police officer and urged the jurors to make a statement with its decision that no one is above the law.
The defense contended the prosecution never proved Thompson acted with bad or evil purpose the night of the incident. Thompson said he was on his lunch break when he first learned information about the suspicious activity, and soon checked himself into the call. “This is the actions of a man that we would be proud of,” Defense Attorney Carl Oreskovich said.
Throughout the trial the prosecution worked to prove that Thompson struck Zehm in the head or the neck with his (Thompson’s) baton. A strike to the head or neck is considered lethal force. “You had evidence from not only the witnesses, but the doctors in this case, that there were strikes to the head and to the neck,” Boutros said. “If you find any willful neck strikes or head strikes, find the defendant guilty of count one.” On Monday, Boutros pointed out 14 baton strikes he considered ‘unreasonable’ or ‘excessive’.
In closing arguments on Monday the defense spoke of Thompson’s long career as a police officer. “This is an honorable man,” Defense Attorney Carl Oreskovich said. “This is not a man who comes up on somebody with a baton. This is a man who is constantly trying to be better.” Oreskovich also brought up a letter written by Thompson’s fellow officers in 2006 petitioning him to apply for the police chief position eventually filled by Anne Kirkpatrick.
The trial moved to Yakima after Judge Fred Van Sickle ruled he did not want pretrial publicity to bias a jury. The incident at the Zip Trip took place five and a half years ago on March 18, 2006. “This is a tragic and terrible story, but you all get to write the last chapter,” Boutros said, “You get the final word and the final word is guilty.”

With that authority comes the responsibility not to abuse essential constitutional rights of those they serve, to be honest in the reports they make, and not block legitimate efforts to investigate allegations of excessive force. It was very important for this community to have the events of March 18, 2006, revealed to the public and to seek justice for the innocent victim of this abusive police conduct. ”
The civil rights charge carries a maximum penalty of ten years imprisonment, a $250,000 fine, up to 3 years of court supervision after release and restitution. The falsification of records in a matter investigated by a federal agency carries a maximum penalty of twenty years imprisonment, a $250,000 fine, and up to 3 years of court supervision after release.
The federal civil rights statutes prohibit intentional acts by law enforcement officials who misuse their positions to unlawfully deprive individuals of constitutional rights, such as the right to be free from unwarranted assaults, illegal arrests and searches. Because almost any matter which presents a violation of federal law is also a matter involving a local or state law violation, deference is given to local prosecutions. But where there is no local action or where the results of the state or local proceedings are insufficient to vindicate federal interests, a federal prosecution may be brought.
This investigation was conducted by the Federal Bureau of Investigation. This case is being prosecuted by Timothy Durkin and Aine Ahmed, Assistant U.S. Attorneys for the Eastern District of Washington and Victor Boutros, Trial Attorney for the Civil Rights Division of the Department of Justice.

Good point, however, if you are referring to Steve Brow, he is a certifiable member of the Dead Kennedies.
He was also co-editor of the classroom newspaper in Mrs. Young’s second grade class at Golden Hills Elementary. Later he wrote for the school newspaper at Fullerton High and was editor in chief of the school magazine, Indigo.
He also wrote for the failed Brea Good Newspaper, and has the framed bounced check to prove it. He covered Sacramento for the UC Davis California Aggie. He wrote for the two failed precursers to the Fullerton Observer, Grass Roots Organizing and The New Voice of Orange County. He worked as a fill-in reporter for the Daily New Tribune of Fullerton when it was a daily.
More importantly he was a member of Mrs. Catlin’s class in fifth grade at Golden Hills Elementary when her husband Buck was an engineer at Hughs Aircraft and before his 20 years on the Fulleton City Council. There he heard arguements between the Diedrich kid before his dad was our Orange County Supervisor and the Dannemeyer kid before he was our US Congressman.
He has heard of other poster’s identities being hijacked, but no one has ever hijacked his. Good thing, for his sister-in-law is an attorney specializing in intellectual property and her son is a grauate of Stanford University in computer science who would have no problem tracing true computer identities.

LOS ANGELES – Assemblyman Chris Norby defended himself Thursday against charges he illegally used campaign funds for a weeklong stay in a cut-rate Fullerton motel in 2007, when he was chairman of the county Board of Supervisors.
Lawyers for the state Fair Political Practices Commission argued before an administrative judge that Norby was having marital difficulties and sought refuge at the Fullerton Inn, where he used $340 in campaign funds for a seven-day stay.

Norby said he was researching homelessness and poor families who stay in budget motels. Campaign funds can legally be used for governmental purposes, including research.
Norby later published an article on homelessness, which cited his stays at the motel and at National Guard armory shelters. He also reimbursed his campaign for the $340, although FPPC lawyers pointed out that both actions came after a newspaper report detailing the motel charge to his campaign.
“The expenditure was made for personal purposes because of respondent Norby’s marital difficulties,” the FPPC’s Luisa Menchaca told Administrative Judge Ralph B. Dash.
Dash has 30 days to submit a recommended action to the FPPC. Norby, who said he turned down a settlement offer from the FPPC because it required him to sign a declaration of wrongdoing, faces a maximum $5,000 fine.
Norby and his wife, Marsha, divorced later in 2007. He married his current wife, Martha, in 2009.
Norby and his attorney, Darryl Wold, built a case that Norby had an interest in homelessness dating back to his time on the Fullerton City Council in the 1990s – and that he didn’t need a place to stay. Norby testified that he only spent three of his seven nights at the motel, sleeping at the rest of the time at the home of previous wife, Charlotte Chai. Chai testified that she’d asked Norby to look after her house while she visited China with Alex Norby, Chai and Norby’s son. She said Norby was welcome to stay there and that she was aware that he’d slept over.
“He had other places to stay,” Wold said. “He did stay elsewhere during that week. He would not have stayed in that location if not for the homeless issue.”
Key to the FPPC case was 2008 Los Angeles Times story on his motel stay, in which Norby called the use of campaign funds a “mistake.”
“I’m going to reimburse the campaign because I was there for personal stay,” the paper quoted him as saying. “The campaign should not have been involved in it.”
Discussing his marital troubles at the time, Norby fought back tears for a moment until Dash called a brief recess. When testimony resumed, Norby said he simply wanted to address the question so that his domestic issues would not be further publicized.
“It was an extreme embarrassment and I wanted to put it behind me,” he said.
He said that at the time, he didn’t dispute the reporter’s implication that he stayed at the motel because of marital problems.
“I said, ‘If anybody thinks that’s the appearance, I’ll refund the money,’ ” he said. “I do not want to argue with reporters. They have the ink.”
Norby spent 18 years on the Fullerton council, seven years on the Board of Supervisors and was elected to the Assembly in 2010.

City Atty. Dick Jones said the city has issued a notice of intent to terminate Officer Albert Rincon.
“His badge and gun have been taken,” Jones said.
Too late. Damage already done. I don’t think women felt any safer after that…because you sure don’t need a badge and gun to fondle and rape women, when your boss (FPD) looks the other way..
Please note: badge and gun were taken AFTER the taxpayers of Fullerton got soaked for $350,000. Had there been no charges filed Rincon would still be preying upon his targets.

AS I understand it, and Independent Review is simply for the city officials to see how the police department is following proper procedures.
I also wonder how effective and accurate it will be.

Gennaco is running a scam. For a 6 figure fee all he does is write an a nicely worded report that makes the public feel warm and gushy and the department say “gee that wasnt so bad”.
What he doesnt tell the public though is that the department that he’s investigating has no duty or legal requirement to cooperate or even provide him with factual information.
If you want real results you have to rely on the city, county, state and federal review or investigation. They are agencies that have teeth and in the Kelly Thomas case I’m really not sure what the FPD conclusion was, the county filed charges, the state declined to get involved and the feds are still investigating.
The office of independent review is nothing more than a private business with an official sounding name like State Bank for California or California State Auction Services.

Guys, I don’t know where everybody is getting their info from and it may be better than mine. But a former LEO, high-ranking, whom I actually trust (I know, I know) told me that she thought Gennaco’s report would not be a whitewash but would contain some pretty damning stuff about FPD.

Marisa did such a great piece that Fullerton activists read the story during the public comments of this week’s Fullerton City Council meeting in its entirety.
