Born To Lose: The Do-Nothing DA’s Recipe For Failure
I’ve been thinking about this for months. It’s been gnawing at my spinal cortex. It’s been chewing on my psyche. It’s been snag-toothing the back of my brain. There is no polite way to put this. OC District Attorney Tony Rackauckas’ case against the goons who killed Kelly Thomas is designed to fail.
There are just too many lose ends overlooked or ignored by the DA. Too many unasked questions. Charges that are mystifying, flimsy, dubious, ultimately useless.
If ever anybody looked like a patsy it was the obese clown Manny Ramos, who, as Rackauckas pointed out, initiated the brutal contact with the schizophrenic, undernourished homeless man. But other than possibly joining the pile on, Ramos is not said by the DA to have been part of the actual beating laid down on Thomas. That was said to have been perpetrated principally by the one-eyed cop Jay Cicinelli, who was hit with paltry charges and a paltry bail.
The Second Degree murder charge against Ramos won’t stick since his lawyer need only point to the damage done by the other cops, four of whom have already been exonerated of any crime by the DA. And Cicinelli’s lawyer will argue that a cop tasering and beating a man’s face into his brain case is not to be considered excessive force by an OC jury, let alone manslaughter, since it never has in the past.
Joe Wolfe, whom we are supposed to believe had no knowledge of what was going on between Kelly and Ramos, a mere 15-20 feet away, and who actually delivered the first blow – a swing of the baton to Thomas’ leg, and who immediately piled on, was inexplicably given a pass by Rackauckas. Is it too conspiratorial to propose the possibility that Wolfe was actually waiting for Kelly to run away from Ramos? How long does it take to search a backpack?
And then there’s Kenton Hampton, whose thuggery has been well-documented on these pages; who arrived on the scene in time to hold down Kelly’s legs as he was being tortured and beaten by Cicinelli. He got a get out of jail card from our DA, too. So did Blatney and Craig, arriving on the scene to participate in the mop up operation, and possibly in phone/film collection activities.
Will the DA even bother going after Ramos anymore? With the preliminary hearing scheduled for March 28th, I wouldn’t be surprised if charges will be dropped, maybe even the charges against Cicinelli, as well. Could Wolfe or Hampton still be charged if the DA has second thoughts about his strategy, and assuming he actually wants to convict somebody of something in this killing? Yes, it’s possible, but not very likely.
I’m starting to think the whole thing was just an elaborate whitewash of a conspiracy; a charade in which a weak DA ostensibly succumbed to public pressure, but never had any intention of vigorously prosecuting any cops. If so we are all in deeper trouble than we can possibly appreciate. I hope I am wrong.
And I hope if I am not wrong that Federal and civil trials will bring to light all of the information our Do-Nothing DA, by his action, or lack of action, seems intent on not disclosing.
I have felt this same way since the charges were read. The DA charged the officers involved as an answer to the outcry of citizens, not to actually try them criminally. He did the bare minimum in regards to bringing only 2 officers up on charges. What about Wolfe? He was there from start and heard everything that was going on, he was only 15 feet away. There are too many buddies that work at the DA’s office that are ex Fullerton police officers. This is is going to be swept under the rug just like everything else. They wanted the waters to calm and the phony charges did just that.

Elaborate, but impromptu, they were fumbling around like imbeciles. I’m quite sure McDodo was called that night for advice, because Sellers sure seemed not know what to do.
As elaborate as the cover-up is, seeing through the propaganda is relatively easy at this point.

This is a very good post. I have had very similar thoughts and feelings on the subject. I remember reading a post that implied the recordings which the DA used to base his case upon came from Wolfes’ DAR because Ramos had turned his off. Is this true? If it is, it would cast suspicion on the assertion that Wolfe didn’t know what was going on. I don’t buy that anyway. What happens if the DA intentionally blows the case, anything?

Some people, around here, that were watching the D.A. announce those charges were puzzled by all the info he was divulging, It seemed as if he was deliberately sabotaging the case against them.

First off when Ramos made the famous statement, “see these gloves, they are going to F you up”.
If in fact that statement by the DA was not a complete statement and Ramos did SAY, in total comment, “if you don’t do what I say and comply”, is ABSOLUTE crap for the DA to include HALF statements.
Such comments by cops have been said many times, and if saying such prevents you from having to hurt someone, I SAY go for it.

Yes the 2nd degree murder charge against Ramos is excessive if Ramos was NOT the one pounding on Kelly. Ramos might be an accessory to Manslaughter since Ramos took no action to stop Cincinnelli.
Not a charge the public could put their arms around, BUT a more applicable one that a JURY might.
Overcharging a person, JUST to look cool in the eyes of the public is nothing but a disaster waiting to happen.
But overcharging HAS BEEN done knowing full well you can’t meet the burden of proof and will get a NOT GUILTY.
The DA will reach out to the unknowing and simple say, “we tried” hoping no one will call BS at the end of the day.
The other glaring issues is not only did the other 4 cops avoid prosecution, they were exonerated in the administrative investigation as well.
OKAY, then Chief Hughes and the others before him, along with the Union should be YELLING BS on DA Rack, BUT their not. WHY???
If they yell once a NOT GUILTY is announced, THEY have nothing to be proud of either, WAITING for things to be safe before they come to the aid of one of there own. SELECTIVE courage is NOTHING to be proud of either.
For those who say that’s BS, there are OTHER police agencies to work for who handle their business in a different way than FPD.
For a Chief to allow his employees to face such charges IF HE or SHE believes they are being made the FALL guy just to make the public happy, is a COWARD for a leader.
Again we did NOT see DA Rack give ANY kudos to FPD during his public comments.

I was thinking more along the lines of “failure to stop” the beating.
I don’t know of any police agency who does not have such a policy on the books written along the lines of such actions that MUST be taken.
And of course violating a policy within your agency is NOT grounds for a criminal prosecution either. TWO different animals and the public MUST understand that.
Generally policy covers what the criminal statues DO NOT.
Maybe one or more of the other cops did attempt to do so, THAT we shall know in time.
But if they KNOW there was an initial cover up, followed orders to REMAIN SILENT, played stupid, because that’s what Chief Sellers told them too.

I would think that it would be to appease the public. I believe a DA has a lot of his career dependent upon police officers. I wonder how many of his convictions could be overturned if SIX police officers were found guilty of crimes such as perjury and murder.
The weak part of my theory is that it involves the DA eating crow, although, frankly I doubt that Rackauckas ever dreamed people would still be talking about this six months later.
Still, eating crow later might have been deemed a small price to pay for taking the heat off immediately last September when the wolves were howling at his door.
Dont forget about the female coroner who’s cause of death was changed by her supervisor at the request of the DA and who will testify to that

I still think that would be STUPID to bring a case to appease the public. I agree though, a DA’s career is dependent upon police.
I think most people hope it all works out in the end, and really don’t want to get involved. That means most people do nothing unless there is a huge incentive, like the Kelly Thomas murder and subsequent cover-up.
Its possible that a war with Iran may bankrupt us like Nepolians army, starving in the russian winter.
By then the economy may be so bad, citizens and politicians alike, may be faced with one hungry group of soldiers that may not want to put up with this bs when they get back home,.

I witnessed a military wife today visibly upset about what happened in San Clemente last week.

The deputy heard the kids and went back to the vehicle. So either he left them to resume pursuing the Marine or did he or someone else stay with them and then just stand there going “duh” when their father returned and was able to get by and get back into the vehicle? Where was this supposed fear for the kids?
Also, if this latest crap is to be believed, why didn’t they simply shoot out the tires? Instead, they shoot him with the kids in close proximity.
Owning a home in this city is an embarrassment these days. It use to be when you told people you live in Fullerton they would say, wow what a nice city to own a home in. Now all I get is, that place is a dump and the corruption runs real deep. What is a homeowner to do with this and the fact that we have so many corrupt council members and cops?

I think the wording is rather obvious to one who has the most basic level of intelligence.
So if Sellers made ANY attempt however slight to cover this up, HE TOO should be standing tall before the People of the State of California.

I did it as a cop more than once. I like many other cops put the case together. ALL the DA had to do is methodically put the FACTS before the jury. It doesn’t take YEARS of law school to accomplish this task.

Proving the “possibility” is hard. DA’s don’t charge people for fun. DA’s reject cases against normal people all the time. Battery with John and Joe. No witnesses. Minor injury. Rejected by the DA. Many factors involved but rejected. DA’s offices file cases they can prove not to appease the public.

Absolutely the only way that the Orange County’s District Attorney will ever not be re-elected with George Argyros and his ilk around to insure that he’s always going to get re-elected, is to do an end around the big money contributors and the police unions, by getting the residents of Orange County focused on the extent of the damage that T-Rack’s corruption and cronyism throughout his time as a District Attorney, and then once people see how this has affected their everyday lives, we get them to RECALL him from elected office once and for all.

Too bad Ron Thomas drank the DA’s kool-aid and doesnt want the video released because it may “jeopardize” this bullshit case. The video should be released NOW so there is such an outcry from the public that it forces the DA to actually do the right thing.

Joe, I agree with everything you said, well written, Sir! I would like to add another observation in the set up to fail charges. The hospital’s cause of death clearly points to Cicinelli being at fault. All Ramo’s attorney has to do is plant doubt in one juror’s mind. He’ll do this by using the hospital’s report and going on how this was made off keen and first hand observation and knowledge…and it was the other guy responsible, not his client.
Just curious, was Wolfe’s DAR also turned off?
On a side note, it will be interesting to see how T-Rackemup handles the obvious death by cop – the Camp Pendleton Marine who was executed in front of his young daughters by an OCSD deputy. Those who think the OCSD are any better might want to rethink that btw. If the DA fails to charge this cop, there needs to be a
That deputy won’t be charged. Just like the Monterey Park cops won’t be charged. Deputy was in fear of danger to the kids. MP were in fear of a crazed drugged out wild man.

Hard to do though without actual facts of cases. You would need victims and witnesses to step forward with actual complaints and actual information that shows a good case that was handled wrong. 2nd hand he said she said wont work. You can always try though. I’m a DA. We try our best.

Marines that are currently stationed at Camp Pendelton are ready to wage their own war with the OCSD if charges aren’t brought over this cowardly deputy who shot an upstanding Marine in front of the Marine’s two young daughter’s as the family was exercising and praying together.
We should all be saddened and dis-heartened, that a Marine who risked his life for us all 24/7 for over 10 years is gunned down by “friendly fire” of a deputy that we as citizens of O.C. employ.

Let’s not forget the play of events as they changed throughout the day:
The deputy was sitting in his car doing paperwork when the SUV came by at a high rate of speed, crashing through the gate arm (funny how there’s only minimal damage from such a high speed crash).
This later changed to the deputy was in pursuit of the speeding SUV.
First it was the officer feared for his life when the Marine started to walk toward him…so he shot him. Keep in mind, in the statement released by the OCSD, there was nothing to indicate the Marine had a weapon.
This was later changed to: the Marine walked toward the SUV and the deputy feared for the kids because the Marine didn’t follow his instructions.
This was later changed from walking toward the SUV to about to get in it. So he shot him, fearing for the kids.
If he feared for the kids, why fire a weapon at someone with them in close proximity, especially when the windows are tinted and he had no idea where they were in the vehicle at that moment or if they were about to jump out to jump to their father putting them in much more danger than the father ever could have if any of this was true. But it’s not as the first statement clearly said the deputy feared for his own life simply because the Marine walked toward him. He never reached for his waistband and I’m surprised this tired card wasn’t played.
I am not here to bash Ron Thomas. If Ron Thomas is happy with everything that has happened so far, GOOD on him.
But if Ron Thomas was ever a cop and worked the streets hookin and bookin crooks like many of us, HE WOULD know or SHOULD know when and where to call BS on some of this.
Sometimes his silence makes me wonder about some of this too!!!!
If Ron had even the slightest clue of internal issues within LE, he’d be speaking up himself.
Ron would know it’s just as important that the brass be held accountable as the street cops.

If it wasnt for the public’s pressure, the ‘do-nothing DA’ would have done exactly that.
Of course to quell the public’s anger, the ‘do-nothing DA’ submitted an extremely weak case full of holes that the defense will rip apart and knowing full well that a jury won’t convict.
Jerry Brown did the same thing with the Bell corruption case.
it took them months to charge the officers involved despite having, audio evidence, video evidence and over 100 witnesses.
And lets not forget that the whole time they claimed that they were waiting for the corners report to complete their investigation which interesting enough took them less than 24 hours to “complete” after “officially” receiving the report.
It seems to me they were dragging their feet and hoping that the outrage would die down over time but when that didn’t happen, they decided to submit a weak BS case full of holes which the defense will tear apart.
They did that because they want their hands clean, they want to say “hey we charged them, don’t blame us, blame the jury for not convicting them”.
Yep. They will both walk. One will get a misdemeanor charge and probation.
These officers will be acquitted without a doubt.
The DA submitted a crappy case full of holes to absolve himself of responsibly and to quiet down protesters.
A few months ago the DA Tony R said on KFI that the combined weight of the all of officers caused Kelly’s death not the actions of one or two officers (Funny he didn’t name which officers were on top of Kelly).
Good luck getting Ramos convicted for 2nd degree murder based on that and the DA’s case against Jay Cyclops is even weaker because his actions according to the DA did not cause Kelly’s death and lets not forget that they completely skipped over Wolfe’s actions.
If any of the recordings start shortly after Officer Ramos contacts Kelly, the defense lawyers are going to say “gee we don’t know what was said or done before hand” also I have a feeling that Ramos ““i’m going to F you up” comment either didn’t happen or didn’t happened the way the DA put it which will further weaken the case.
The DA is just filing this case because they want their hands clean, they want to say “Hey! We charged them. Don’t blame us. Blame the jury for not convicting them”.
In the meanwhile I expect some sort of multi million dollar settlement with Ron between the time this goes to trial and before the verdict to shut him up.
They’re not going to work with Garo Mardirossia to go over additional evidence, they are not going to call all of their witnesses and they have no interest in the medical reports released.
The so-called Gennaco “Investigation” is nothing more than a scam meant to bilk tax payers out of thousands of dollars and in return they will get a nicely worded report that makes the public feel warm and gushy and the city say “gee that wasnt so bad”.
Gennaco isn’t working on an “official” capacity, he is a private citizen/entity (like this blog) so the city, police department, etc has no obligation to cooperate with him or give him accurate information.
This is not justice for Kelly. This is a whitewash.

Isn’t it nice that Rusty’s commission professes to protect the public from abuses committed upon them by law enforcement? If you don’t believe me, then ask Pat McKinley who proudly served Rusty as a member of his commission’s board.
It’s not up to Ron Thomas regarding charges being dropped. The cases are titled The People v Ramos and Cicinelli, not Ron Thomas v Ramos and Cicinelli. Crimes were committed and charged, a settlement would only be between the city and Ron Thomas and have no bearing on a criminal case.
I never said or remotely implied that.
This is what I said: “I expect some sort of multi million dollar settlement with Ron between the time this goes to trial and before the verdict to shut him up.”
No matter how you slice it, they (by that I mean the DA and the City not “the people) expect the case to fail and when it does they do not need Ron Thomas screaming outrage and the community demanding justice. I suspect what is going to happen between the trial and verdict is they’re going to make him a nice offer and fast track it provided he agrees to their terms (and of course most settlements are confidential so don’t expect any parties involved to disclose the terms).
Judging by his reluctance to have them release the video and his attorney’s sudden silence makes me think an offer has already been proposed.
They’ve already tried to pay him off once before but the amount of money was laughable considering the crime committed.

Settlement negotiations are confidential, but the city must disclose any actual settlement as soon as the deal is done.
Would they be required to disclose the full terms or just the amount?
For an example if they reached a settlement for $4,520,980.98 and one of the stipulations is that Ron cannot say x, y and z about the city as it relates to the death of Kelly, would they be legally required to publicly disclose what x, y and z is?
The terms are written on to a piece of paper to be signed by both parties, and that piece of paper is a public record.
Do we know the terms and conditions of the settlement involving Albert Rincon’s victims?
I looked into it and all I see is this LA Times article which quotes unnamed sources:

That sounds like Andrew Goodrich’s version of events. I don’t recall that anyone has ever indicated that this Marine’s daughter’s were in any sort of distress, or had indicated in any way shape or form that they were being held against their will.
Bottom line is that the deputy grossly over reacted and killed the girl’s father right in front of them in cold blood, and you’re saying that it was justified for the deputy to shoot first and ask questions later.

To be clear on the whole thing per first reports. He and his family did morning prayer walks at the field at San Clemente high school with bible in tow. The mother is almost 9 months pregnant and stayed home with their toddler. No one knows why he crashed through the gate but damage to the front of his Yukon was very little, as seen in pictures. His speed obviously wasn’t that great imo. Nothing ever said he tried to run or hide. He merely began jumping walking toward the deputy. For whatever reason he didn’t or couldn’t follow instructions, the deputy shot and killed a man who had no sign of having any weapons nor reached for his waistband, in front of his 9 and 14 year old daughters.

A “conflict of interest”.
What does that mean, really?
I say anything that would create you grief in having to explain anything that might be questionable as to circumstances, YOU should have known about prior to you taking action.
In the many city’s I patrolled, and the one I lived in, I had friends like anyone else.
Sometimes those friends got into trouble or called the police for help.
I got the call in some of those cases.
I had TWO immediate conflicts to consider.
Example 1.
A couple I know are having a domestic dispute and it sounds like violence between the two has taken place.
Example 2.
A friend of mine has called police who is having a dispute with his neighbor, trouble is brewing and this fued is not the first.
In reality HOW am I going to handle this problem, and everyone is happy with my decision and avoid a potential future complaint that I was baised towards one party because of said friendship or known association?
If I handle the domestic dispute, one party will no doubt think I am siding with the other.
If I handle the neighbor dispute, and the neighbor finds out I am friends with the guy who called, and rule against the neighbor, then I am covering for my friend.
If I rule against my friend, then I am no longer his friend or never was according to him, cause a friends would never do that.
A NO WIN situation.
What should I have done. NEVER handle the call to begin with. I pass it off to another cop and let him handle it and AVOID the appearance of conflict PERIOD!!!!
If you gamble and lose, you ONLY have yourself to blame because the little man in your head told you so the second you got the call. Hopefully your experience of seeing others get into trouble has taught you well.

If DA RACK has any friends, close associates on FPD or within the city for whatever reason, is reluctant to prosecute EVERYONE who is deserving of prosecution, HE should have avoided getting involved in this case in any way shape or form from the start.
The DA should have passed this WHOLE mess off to the FBI and BEGGED them to handle it no matter what the outcome.
Who could and would truely say the DA is a bad guy if he stood up before the camera’s and said, I have alot of friends in this City, I do not feel it would be fair to them or the people if I handled this case.
He is avoiding the appearance of conflict, and I for one, WOULD NOT think bad of him for doing such having been there done that myself.
If we find out the DA took the gamble, and he is covering for ANYONE, then what ever he get’s, he deserves at the end of the day.

I hope Sheriff Hutchins has the forsight to see this as a potential problems and will meet with the base commander, then maybe those troops who are upset. ASAP!!!

The officers responded to a radio call. They attempted to lawfully detained Mr. Kelly. He attempted to flee and was lawfully detained. He resisted the officers attempt to restrain him.

If Ron has lots of guts and really wants to make a foundation for the homeless he will wait for the verdict which is based on the preponderance of evidence and does not have to be unanimous. A killing that is unjustified will be a huge award. They will have to double the water tax! I agree with this post greatly. I’ve was upset immeadiatly after Tony’s news conferance that the real perpetrater was getting a slap on the wrist for his action against Kelly. I believe thats why Tony does not want the tape out which would contradict the picture he painted of who he wants us to think is the perpetrator.
The aspect of this I don’t understand is why McKinnley is “violently” opposed to releasing the video. A failure of the criminal suit would increase pressure to do damage in the civil suit which would increase the potential “liablility” against the city.The liability of the city is what the council seems most interested in. Let Whittiker see the Tape! He has a good reason for wanting to see the tape.Some one has to hold the unpredictible DA accountable. Allowing Ron to have that leverage of knowing what Whittiker (a city leader who has earned trust) doesn’t seem balanced.Whittiker could have no possible vested intrest which would sway his opinion for containing the video. I believe failure of the criminal case could rest hugely on the decision of the release of the tape to the public. It could be that the public will never in fact view the tape at all if the case is dismissed. It was the public view of the tape that eventually got justice in the Rodney King trail.

Funny thing the Slidebar is a partner in the fundraising over at my kids school. They have been bringing home colored papers with the the Slidebar’s name at the bottom. I dont know what an elemenatary school is doing branding a watering hole. I guess anything goes these days. Whenever the D.A.R.E officer from the FPD shows up the kindergartners end up drawing syringes and straws and the so called “art” ends up on display at the school. it took me a few days to absorb all DA quotes and charges but one thing that concerned me almost immediately aside from not charging the others with anything, was that if this goes to trial (and it should) that it only takes 1 coplicking fascist (gee, wonder if there are any in OC) on the jury to vote not guilty for mistrial to occur-and the same thing would happen in a retrial,

ACU. You proved the main point. The union President tried his best to explain things yesterday due to all the media versions of what the media wants to say. He failed because he can’t use facts of the case, just generalities. PIO Jim is the same thing. As you know, the cop isn’t talking to anyone outside of public safety specifics. So Jim is going on info bosses are getting second hand, and a general, non specific summary. This day was a perfect example of why people just need to provide the general summary in a press release and leave it at that.
ACU, I was really surprised at the assertion that there has been long standing tensions between the Marines and the OCSD. I suppose this relates a little to Fullerton in the respect that a proposal to disband the FPD and replace it with the OCSD has been blogged about from time to time. Is the author’s position about the longstanding corruption via drugs and prostitution among OC LEO’s a valid one? Does Raukacus work with those offcers as well as FPD? What are your thoughts?
Police claim he disobeyed their orders.
Police have told two stories, one that they had chased the SUV and it “broke through a locked fence,” one that has been open every other day as required. That version has Loggins outside his SUV and refusing police orders.
The second version police have given says that a patrol car pulled behind the high priced Yukon SUV containing Loggins and his two daughters. It all gets very sketchy from then on, police “orders” not heard, not obeyed and, more appropriately, no evidence of “probable cause” for police to have approached the hero Marine with a long record of public service, a continual community volunteer and excellent citizen.
Loggins bullet riddled body was checked, no drugs or alcohol. All that was found were two terrified children and a blood soaked bible. There were no weapons on Loggins, none seen, none in the car.
No one searched police for drugs, no one tested them for drugs or alcohol, nobody got to interview their families, their names weren’t even released.
The next two paragraphs are even more telling (if true) in my opinion.
I would agree with that. Difficult for the layman to explain without the guidance of competant council.
But some of us know how to explain and articulate all that.
If some things don’t change, I can see more of that happening win or lose.

Two friends who had planned to visit a Seattle sports bar claim they ended up being kicked, arrested at gunpoint and held in jail for several hours by a cop who said he intended to “make stuff up.”
Part of the arrest of Josh Lawson, 23, and Christopher Franklin, 22, on Nov. 16, 2010 is caught on tape by the officer’s dashboard camera.
But key moments of the arrest that should have been captured on video are missing and it was unclear whether the officer intentionally neglected to turn on the dash cam. None of the released footage shows the officer in the moments he made the stop or kicked Lawson.
The accusations against Richardson are among many that have put a spotlight on the Seattle Police Department and it comes after the release of a Department of Justice report in December that said “serious concerns about practices that could have a disparate impact on minority communities” were raised by its review.
The recording of the arrest was released after ABC News affiliate KOMO began an investigation into missing police dashboard camera videos.
The recording of the arrest of Lawson and Franklin — who were picked up for allegedly assaulting and robbing a man a short time earlier — shows the suspects being helped from the ground and into the patrol car of Officer Brad Richardson.
The officer’s uniform microphone also records Richardson telling the suspects, “Yeah, I’m going to make stuff up.”

If the OCDA flubbs / loses this case, federal authorities will commence pressing civil rights charges against these animals as well as felony assault and murder. The Feds play to win. These animals from FPD deserve to live the rest of their days in a cage for this injustice.

Obama should be using his attorney general and US Attorney for this district to oversee DA Tony. DA Tony is an Orange County Conservative Republican. Obama is not. Since Republican presidential nominee will march to Orange County to raise funds, what would be better than to embarrass the entire GOP organization in OC than have a second more searing investigation that charges the uncharged and finds the OC DA lacks competency.
Its sort of like getting back at the GOP for the Acorn abuse or that Reverend who spewed forth venom in Obama’s former church.
If I were a democrat, I would be sooo happy with this entire situation. DA Tony is a lacky of the police unions. Just check on his contributions, a few rich OC ultra right wingers and the police unions. What a combination!
