29 Jan Council Vacancy Agenda

The following came through from the City Clerk’s office regarding the agenda for tonight’s special meeting:

“Following applicant presentations, City Council will hear public comments regarding filling the City Council vacancy. After public comments, City Council will deliberate and vote to appoint an applicant to fill the vacancy through December 2020.”

It looks like the cat is out of the bag and this farce can be put to bed. The council is going to appoint somebody and all discussions related to a special election and the integrity of voting rights, transparency and openness is and was just gloss. You can’t claim to be open and transparent when you’ve already decided, without public notification and input, on the council’s decision before the “special meeting” meant to decide the very issue of direction.

Don’t think the council has decided already? Then ask yourself why 2 of 4 council members couldn’t even be bothered to show up to the Neighbors United for Fullerton (NUFF) forum last night? Not one of them was present for the entire event, a whole whopping 2 hours of their precious time was too much to give up for this oh so important open process.

Silva gave an opening statement and Whitaker stayed the longest which is amusing considering he voted for a special election and was the only voice really against this sham. The “public forum” that council directed staff to ask about and that council voted to approve and that NUFF was kind enough to host – was too much of a hassle for our council to attend. Go figure.

NUFF by the way deserves a hearty thank you from the citizens of Fullerton for rearranging their agenda to accommodate this charade. It’s not NUFF’s fault that Fullerton’s council acts like Fullerton’s council. NUFF did a great job all around and I personally thank them.

On a personal note, it was nice to see Josh Newman acting like the man I voted for in 2016 and not the man we recalled from office in 2018. I know he loathes me, which is fine, but you wouldn’t have known it last night which is what mattered.

Back to the travesty of the appointment process – with all of the behind the scenes meetings, deal making and huckstering going on right now it’s anybody’s guess how long it’ll take tonight for the anointed one to finally be appointed.

Should the obvious not happen, the council has a pretty good crop of people if they’re looking to find the least suitable, most mathematically challenged applicant to rubber stamp higher taxes and less accountability for staff. I counted at least 3 people in last night’s beauty pageant who wouldn’t hold anybody accountable or demand fiscal restraint – which really is a hallmark of Fullerton’s electeds.

I’m probably the only person who put in an application who can unite the council – but that’s because they’re united in not wanting me anywhere near that dais. Heck, I’m pretty confident that I wouldn’t want me anywhere near that dais.

As far as beauty pageants go I was the best dressed but we never made it to the swimsuit competition or special talents so that was sad. Maybe tonight will be different. Maybe not.

Fullerton’s Council Beauty Pageant

After some debate, a short delay and a little snapping by Jennifer Fitzgerald, a council majority opted to hold a beauty pageant to decide which crony will get to join them on the dais.

The city is accepting applications for contestants who are interested in the job of city council without the need to actually convince the citizenry to vote for them.

We won’t know who all is running until the application process ends but we’ve already heard some names and most of them are terrible if you care about the city budget or basic math skills.

In the ongoing process the council will pretend to view and vet the candidates in an “open and transparent” process which means closed door meetings and private wheeling and dealing with a dash of favors and/or threats for good measure.

There will be a “candidate forum” sponsored by the Neighbors United for Fullerton but really it doesn’t matter who you like or what they say to the public because the council is making this decision regardless of your thoughts or opinions. You have no real voice in this process despite empty promises to the contrary.

Let us not kid ourselves, despite applications being due by Wed, 23 January and the NUFF forum being on the 28th, this will be a done deal long before you get a chance to even know who’s all in the running and who can twirl a baton the best.

The meetings are already happening and the deals are already being struck – hence Fitzgerald, Flory and the Flor-Bots all shilling for Flory back in December before this process even started.

You can apply if you’re a masochist or you can just show up to the forum and council meeting to watch the slew of candidates take 8 boilerplate questions about the roads and zero about pension reform and overspending. Overall don’t expect the public face of this charade to matter much in the actual decision making process.

However if you want to pretend like you have a chance to be on city council and believe you have what it takes to beat back the leviathan and fix our structural deficit then all you have to do is fill out a few pieces of paper to apply. Apply Today. The more the merrier.

I was pleasantly surprised at Fullerton’s City Council meeting last night and that rarely happens. I was surprised because Ahmad Zahra stood his ground on the principle of Democracy being the preferred way to settle our current council vacancy caused by Jesus Silva. He withstood Fitzgerald’s venom laced claws and boxed Silva in so much that Silva had to contradict himself by claiming to believe voting is important except, you know, with regards to, uh, the vacancy he created in playing musical chairs.

I had heard going into the meeting that Jan Flory had lobbied 2 if not 3 of the current council members to be appointed to the vacant seat. I had also heard and believed that Fitzgerald and Silva were going to push for an appointment process to get the Flory ball in motion. I also knew, just from historical context, that Whitaker would vote no on that because he and Flory are opposites on most items and he gains nothing by supporting her. I did not know how Zahra would act or vote despite allegedly meeting with and being lobbied by Flory. Owing to Zahra’s campaign and his coziness to people I believe to be ethically challenged I didn’t hold out much hope and assumed he might go along to get along.

Then Zahra showed up to play ball and stomped on my assumptions. (more…)

Is the Flory Rumor True?

Rumor has it that former councilwoman Jan Flory is lobbying to become the appointee to our City Council tonight and has already secured both Jennifer Fitzgerald and Jesus Silva’s votes. This is the same Jan Flory who voted, with Jennifer Fitzgerald and Doug Chaffee, on multiple unbalanced budgets and who helped lead us into our structural deficit. The same Jan Flory who puts City Staff above the very citizens they’re supposed to work for and represent.

Want to know why our roads suck so bad? Blame Jan Flory and her cohorts who think bureaucracy is the true heart of Fullerton. Want to know why Downtown is such a train-wreck? Yeaup. Same cabal of incompetence.

If the council votes to appoint somebody the voting members will own every vote put forward by the new council member. In effect, if they vote for somebody like Jan Flory, who helped sink our budget for years, they will be responsible for both their own votes on the budget (and similar items) as well as hers.

Appointing somebody is bad. Letting Jesus Silva vote on an appointment to the very seat he himself vacated is worse. Having council vote to give themselves the bulletproof majority needed to walk all over the people of Fullerton is downright despicable.

The people should really have a say who in represents them and voting to appoint somebody, especially somebody who will raise our taxes, is the essence of being anti-democratic. Our republic was literally founded against the premise of taxation without representation.

Chaffee’s Last Crony Grasp on Council

Just when I was preparing to see a new chapter of shenanigans in Fullerton coming from our new council, instead from the realm of ARE YOU F^&$&ING KIDDING ME comes Doug Chaffee trying to slap Fullerton with one more bit of cronyism before he leaves to play at the county level.

Less than two short weeks ago the council voted, 3-2 (Sebourn, Silva & Whitaker vs Fitzgerald & Chaffee) against an unsolicited bid for a hotel on the parking lot near the train station at Santa Fe and Ponoma. Cooler heads prevailed and a more open, transparent and honest process was suggested.

Now Chaffee, who per the City Manager agendized this item, wants to crush that transparency and openness in his last meeting this coming Tuesday. To make matters more unpalatable the council/staff arranged the agenda to swear in our new council member (Zahra) and say goodbye to the ones leaving (Sebourn & Chaffee) AFTER they vote again on this hotel nonsense. For the uninitiated there is a vendor who wants to build a hotel and Fitzgerald and Chaffee want to hand it off to them without opening a bid process to interested parties. It’s cronyism and backroom dealing 101.

This is truly a slap in the face to both Ahmad Zahra and District 5 as this new development would be in their neighborhood and the first District 5 candidate will have no say on it because the agenda lets Zahra join council mere moments AFTER this hotel’s fate is already decided.

This coming back this quickly means one thing and one thing only – somebody got to Silva* as he’s the likely weak link on this issue.

For reference here’s what Silva said about the ENA at the last meeting at approximately the 3:30:12 mark:

“I think an RFP, or a bidding, would help the city I think, would help us get the best possible product. Competition drives, brings out the best in you. And I think having that can bring out the best in the current applicant and someone else.”

We’ll see if Silva still believes this on Tuesday or if all of the sudden competition is less important than craven cronyism. Even if it’s the case that Silva changed his mind, does he really think so little of fellow Democrat Ahmad Zahra that he’ll prevent him from voting on an issue that residents of District 5 have officially elected him to decide on?

This is just dumb, unnecessary, and silly. One can’t help but wonder if this is really Doug Chaffee being that tone deaf or if it’s really retribution for Ahmad Zahra winning a seat his wife coveted in the first place.

Because, and let’s be honest, if Paulette Marshall Chaffee won this election, Doug wouldn’t be preventing her from voting on Tuesday.

City is Still Shilling for Bar Owners

For the last, well forever really, the city has been trying to figure out how to change downtown to make it more… something. I can’t quite figure it out. By the looks of it the only goals City Staff have are to pack as many residents into as many high-density apartment complexes as possible and to hand over as much of Downtown to the local “restauranteurs” which is Ted White (Director of Community Development) for “Bar Owners”.

This past Wednesday night one such plan hit our Planning Commission. The plan was 70+ pages of muddled definitions and empty promises. I’ll summarize:

City Staff has been ignoring their jobs and our municipal code for 15+ years because reasons. It’s hard to do the job we pay them to do so they want to do less of it and they want to relax the rules so the rule-breakers have fewer rules they have to break while making piles of money.

Instead of cleaning up bad definitions and attempting to hold businesses responsible for the melees enveloping downtown each weekend, the city would rather permanently legalize downtown getting louder and more rowdy with the promises that this time, with no indication of staffing changes or practical enforcement, they’ll hold bar owners to a standard of behavior, or perhaps a guideline, or at least an amorphous shape resembling a line if you squint really hard.

It reminds me an old UN Peacekeeper joke where whenever they see somebody doing something wrong they yell “Stop! Or I’ll Yell “Stop!” Again!”. This time they mean it for realsies.

Ultimately Wednesday’s item was held until a possible study session in January and a new meeting in February, which is when we’re totally screwed. The bar owners will get everything they want and then some come February because the Planning Commission is changing. A lot. (more…)

City Lies While Attempting Hostile Takeover of Library

Odds are that the Fullerton City Council will vote tonight to fire the Library Board and replace it with themselves in a cynical attempt to steal property to offset some Police & Fire Pensions. Fitzgerald wants to do it, Chaffee wants to do it and it likely won’t take much effort to convince Silva to do it.

Why? Because the city needs to pad the budget to fill holes left by Public Safety Pensions and totally predictable but avoided CALPers issues.

Thus the City is planning, under Ken Domer’s guidance, to take property donated to the library to plug General Fund budget holes.

Donated. As in stealing charity. Love Fullerton, indeed.

This is the brainchild of Councilwoman Fitzgerald despite her original campaign rhetoric about libraries being a “core service”. I guess we can just add this to the long list of lies Jennifer Fitzgerald said to get elected. We’ll put this one right up there with her promise not to take a salary and to desire to implement zero based budgeting.

Oops. Fooled you!

The Burgeoning Field to Replace the Little Corporal

It was easy to predict that after his announcement that he was quitting Congress at the end of the year, a host of would-be successors would jump in to replace Ed Royce (R-Security State). And so it has transpired. The lure of Congress is too hard to resist for the career politician – just think White House photo ops and no term limits.

There were already a bunch of Democrats challenging Royce, none of whom I had even heard of. It’s the Republican crowd that is of interest because the top vote getter of this tribe will probably reach the November run-off; possibly even against another member of the same club. We’ll ignore the no-names and the Fruit Loops.

First there is Young Kim, a wholly owned subsidiary of Royce, who has in fact, endorsed her to carry on his sterling legacy. Kim lost her last election as an Assembly incumbent, and that doesn’t bode well for the cynical north OC “Asian Strategy” that also failed so spectacularly in 2016 for Sukhee Kang and Ling Ling Chang. Poor Young may have access to some of Ed’s left over campaign dough, but she has the problem of coming across as just another empty suit and the puppet of her husband who created her political career, such as it it.

4th District County Supervisor Shawn Nelson’s suit is far from empty, his record at the County has been a complete disappointment. Elected in 2010 on a platform of accountability, pension reform and a full cross-departmental audit, he immediately ditched accountability, engineered a massive pension for himself, and has done nothing to shrink the bureaucracy or establish any kind of bureaucratic competency. Just the opposite, in fact. Fullerton residents will recall that Nelson tried to look good at the County by sneaking a homeless shelter into strip center next to an elementary school and a residential neighborhood in East Fullerton.

Then there is former State Senator, Bob Huff, the former legislative waterboy for Redevelopment and occasional Traditional Values panderer who was termed out of his Sacramento gig and who also lost his last election – a try for LA County Board of Supervisors. Huff may count on an influx of money from people who used to lobby him, and of course the very deep pockets of his patron, Ed Roski, who owns the City of Industry. Huff is the veritable poster boy for government griftery. It’s hard to see how Huff can get any traction in OC against other ‘pugs, but he’s wishin’ and hopin.’

That’s it for now although we may see other entries. At present, there are no candidates who can run on a real conservative record, although they will certainly tell you otherwise as they invade our mailboxes with their trash.

A Trip Up and Down Memory Lane…AKA The Pine Wood Stairs.

“Pine Wood Stairs” looked a lot better in concept than in reality…

Back in May, FFFF documented the lamentable construction disaster of the Pinewood Stairs, a $1.6 million boondoggle created by City staff, whose construction defects were so bad and so plentiful that a reasonable person might even inquire about how we could get our money back. In fact, City Councilman Sebourn mumbled something about getting our money back, then said he was just kidding. Bruce Whitaker said nothing at all. On Facebook City Hall bureaucracy advocate Gretchen Cox cooked up a story about some alleged City “report” that exonerated all concerned.

Nine months have passed and I thought it might be interesting to revisit the site of the fiasco and share a visual tour to take another look.

Here’s a typical example of a project with nobody in charge and nobody who knows what they’re doing.

The caisson footings with the wood posts are almost all cracked; some of the posts aren’t even vertical. Some of the caissons are out of plumb, too.

Aspects of the construction reveal building that was cobbled together to make the contraption fit together.

Now, as then, the wooden rails are extremely rough and splintiferous.

The lack of quality workmanship, structural and cosmetic remains in evidence. And those fraying cable ends? Why, they’ve been taped! Of course the tape is falling off.

Simple things – like removing the cardboard tube form from the caissons seem to have eluded the City’s crack inspection team. Crack. Get it?

Basic design oversight problems were jerryrigged and never addressed properly at all.

Weird features that are nothing but potential for risk management headaches and taxpayer payouts are still much in evidence – like this trip hazard. Shrug, indeed.

Loose cables. Down the hill goes the toddler.

As usual, maintenance of public property remains a challenge for the City. Loose ends are not their specialty.

How hard is it to keep a tree alive? Don’t bother asking. You won’t get an answer.

The effects of the inevitable pedestrian shortcuts betray both design and maintenance failure. It looked better on paper.

We have been assured by people who don’t know what they are talking about that everything was just grand about this grand failure; but, the evidence did and still does point to the exact opposite: a project that suffered from fundamental design shortcomings, incompetent and careless construction, a construction manager whose only function seems to have been to cash our check, and inspectors who were (and probably still are) a disgrace to their profession.

As you can see driving up Harbor, the City is now building its splendid new entry to the park – including a bridge – costing millions and accomplishing nothing but wasting park construction resources. Apart from the obvious uselessness of the project I have to wonder if it will suffer from the same dereliction that informs the so-called “Pinewood Stairs.” Nothing leads me to hope for the contrary.

Ed Endorses Young Kim

Running true to form, Ed Royce (R- Bad Dye Job) has apparently endorsed his vacuous protege, Young Kim, to replace him in Congress. It would seem that the job of County Supervisor isn’t as inviting an opportunity for this dedicated public servant to be serviced by the public.

This really isn’t much of a surprise, given the Little Corporal’s penchant to endorse unqualified candidates for office. Of course a ling cod would make a better congresscritter than Young Kim, but that cuts no ice with Royce, whose career has been marked by a decided indifference to the well-being of his constituents.

This is good news for Tim Shaw who is now the only Republican candidate for 4th District County Supervisor, and as things stand, would certainly make a run-off against the Democrat’s carpetbaggin’ union goon, Coto Joe Kerr.
