Fullerton Retaliates, Threatens Family to Cover for Bad Cops

For some lawyers, every problem is a nail. Don’t like what you see? Take it personally and swing a hammer as hard as you possibly can. Damn the consequences and damn the people involved, what matters is your pride and smiting that heretical nail.

Unfortunately for Fullerton taxpayers, that’s exactly the mentality of the legal wunderkind at Jones and Mayer. Annoy the city and get the legal equivalent of “See these fists? They’re getting ready to fuck you up.” We all know how well that strategy of bullying and brunt stupidity worked out for all of us the last time around. Yet here we are, repeating history, and somehow expecting a different result.

Many of you wonder why the many writers associated with this humble blog post under fake names. Some of us own property, some of us have kids, some of us have parents in Fullerton, and some of us own businesses in town. All of us have been threatened by city employees as a result of our participation in local politics. Most of us don’t want to have our lives turned upside down because we want the city to fix potholes instead of covering for employees who lie, cheat, steal, and occasionally beat members of the public. A few of us are made of tougher stuff and attach the real and personal consequences of speaking up for the public to their livelihood. Sometimes it’s a black sedan parked across the street from your house, sometimes it’s a little something special left in your trash can, others it’s anonymous letters sent to clients and employers, and for some (now former) contributors to this blog it’s literally two men dressed in black wearing a silver badge showing up on your doorstep at 11pm telling you and your wife it’s time to leave town. Most of you won’t believe any of that, but to one degree or another, every single one of us had something occur within six months of criticising a member of city council or a senior employee at the city or union. Fullerton plays for keeps, so keep your mouth shut or bad things will happen.

Why? Because if voters really understood that brass at FPD really do intimidate submitters of official complaints from women sexually assaulted by officers, really do lie under oath to protect those on their side of the thin blue line, and really do withhold backup from officers who report evil cops to internal affairs, they’d revolt and throw enablers like Jennifer Fitzgerald, Jan Flory, Doug Chaffee, and the recalled bald tires out of town on a rail. While the abuse at the fire department and non-public safety positions is comparatively much less severe, we still have evidence of employees drinking on the job, destroying city assets, stealing property, and using their official capacity to profit both on and off the taxpayer clock. This stuff literally happens every single month and FFFF is the only local information provider willing to publish accounts exposing just how bad things are.

Want to know why our roads look like shit? Well, read the archive. You’re not dealing with decision makers who are pure as the driven snow. They have a vested personal monetary and political interest to keep the public in the dark.

So, I put it to you reader. If you were a city official wanting to keep the voters in the dark, what’s the best way to make sure facts, accounts, or even just rumors make their way out into the public for consumption?

Clean up the city? Stop the lying, cheating, stealing, pussy grabbing, and beating of people?

Come clean and ask for forgiveness? Simply tell the truth about lying, cheating, stealing, pussy grabbing, and beating of people?

What about just locking it down and staying quiet. Just don’t acknowledge the lying, cheating, stealing, pussy grabbing, or beating of people?

Nope.

Fullerton goes with it’s version “WE ARE SPARTA!” method of attacking the messenger. Don’t like that your lying, cheating, stealing, pussy grabbing and beating of people is getting out in public? Break the knees of anyone telling that story and your problem gets solved real quick. After all, if it fails, it’s not like you’re going to jail for wrecking someone’s life.

Last week, one of our writers Joshua Ferguson, announced he had filed suit to get access to documents Fullerton is legally required to produce concerning city employees lying, cheating, stealing, pussy grabbing, and beating of people. Guess what FFFF received a week later as a direct consequence of standing up to the entrenched and belligerent interests at city hall?

That’s right, two of our named authors are being sued. Along with an employer.

Why? Because the city knows exactly what will happen. Screw mortgage payments, screw tuition bills, and screw putting food on the table: You didn’t shut up when we told you to, so now we’re doing to take your whole fucking life away because we can. Enjoy these fists fucking you up. Good-bye paycheck and hello desperation.

In the end, perhaps the court will see this isn’t even a thinly veiled attempt to attack the public’s right to know, free speech, and the fundamental precept that the government shouldn’t use its resources to go about wrecking lives. If that happens, it will be years or months from now, you will pay the bill, and the damage caused by Jones and Mayer swinging their hammer will be done. This blog has 3236 articles and counting. Hundreds of news stories emanating from bad things at city hall were broken here. All of that threatens to come to an end because our writers won’t risk being attacked by the local powers at be for telling the truth.

Be that as it may reader, remember this: Your roads look like shit because people like Jennifer Fitzgerald and those who support her would rather spend her time attacking messengers and threatening families than make hard choices about how big the raises should be for those who endorse her campaigns for office.

This is your Fullerton. If the endless supply of stories concerning lying, cheating, stealing, pussy grabbing, and beating of people hasn’t gotten your attention yet, maybe this latest round of intimidation will. In the meantime, your roads are as shitty today as they were yesterday, and they’ll still be shitty tomorrow when this lawsuit moves forward.

Fullerton Officer Paez Charged with Filming up 16yo Student’s Skirt

Former Fullerton Police Department School Resource Officer Jose Anthony Paez has been charged with a misdemeanor.

From the District Attorney’s Press Release:

FORMER FULLERTON POLICE SCHOOL RESOURCE OFFICER CHARGED FOR VIDEOTAPING UP HIGH SCHOOL STUDENT’S SKIRT

SANTA ANA, Calif. – A former Fullerton Police Department school resource officer has been charged with secretly photographing and videotaping up the skirt of a 16-year-old high school student.

The Fullerton Police Department initiated an internal investigation into accusations that Officer Jose Anthony Paez was acting inappropriately while on duty. The investigation spanned the last five years of the officer’s on-duty interaction with the public.

The internal investigation revealed several photos and video clips taken on Paez’ personal cell phone in November 2017 that were shot up the skirt of a 16-year-old high school student while Paez was conducting a police investigation on school grounds.

Paez stopped working for the Fullerton Police Department in May 2019. The Fullerton Police Department referred the case to the District Attorney’s Office for criminal prosecution.

“As the elected District Attorney, I am charged with judging the conduct of police officers,” said Orange County District Attorney Todd Spitzer. “Law enforcement officers are entrusted with a tremendous amount of authority and trust. The actions this officer engaged in betrayed that trust and preyed on the very people he was charged with protecting.”

Paez is scheduled to be arraigned on October 2, 2019 at the North Justice Center in Fullerton. He faces a maximum of one year in the Orange County Jail if convicted.

Deputy District Attorney Laila Nikaien is prosecuting the case.

A quick phone call to the DA’s office reveals that Paez is being charged with PC 647(j)(2):

“(2) A person who uses a concealed camcorder, motion picture camera, or photographic camera of any type, to secretly videotape, film, photograph, or record by electronic means, another identifiable person under or through the clothing being worn by that other person, for the purpose of viewing the body of, or the undergarments worn by, that other person, without the consent or knowledge of that other person, with the intent to arouse, appeal to, or gratify the lust, passions, or sexual desires of that person and invade the privacy of that other person, under circumstances in which the other person has a reasonable expectation of privacy. For the purposes of this paragraph, “identifiable” means capable of identification, or capable of being recognized, meaning that someone could identify or recognize the victim, including the victim herself or himself. It does not require the victim’s identity to actually be established.”

The DA’s office seems to essentially be charging him with peeping when there are questions of possession of child pornography in the audit conducted by Fullerton Police.

The Fullerton Police Department issued a Press Release written to show how awesome they are and how committed to openness and accountability they are – despite have little to no details in the release itself.

The closest we get to details is as follows:

“When the criminal investigation concluded, Fullerton detectives requested the Orange County District Attorney’s Office to review the case for filing criminal charges against Officer Paez, whose employment with the Department ended in May 2019.”

Notice how as don’t even get to know if Paez was allowed to resign or if he was fired. The Press Release then goes on to extoll the unearned virtues of FPD:

“We are committed to being first to hold accountable those within our organization who do not meet the high standards we set for ourselves. That is exactly what happened in this case.”

This is the same city/department that worked out a settlement agreement with an officer to expunge Internal Investigations into her conduct specifically to bypass disclosure laws.

That settlement agreement, and this story about officer Paez are two of the things we wrote about a couple of months ago are some of the stories that led to the City of Fullerton threatening us with prosecution for telling you things we think you have a right to know about but they want kept quiet.

Prepare for City Manager Ken Domer, Police Chief Bob Dunn and the entire council and school board to keep you in the dark as this “ongoing case” works through the system. The city has yet to even give us a date for when Paez left the force or who’s phone the child pornography that FPD found in their audit was on – Paez’s personal one or his department issued phone. Nor have they explained why an officer had student sexts and underage pornography on any device so easily accessed.

Is this just another case of a badge giving somebody a slap on the wrist when a civilian would have been prosecuted to the full extent of the law?

The Dysfunction of Downtown Fullerton

Friends for Fullerton’s Future just received a disturbing story accompanied by a photograph that seems to encapsulate the Downtown Fullerton experience:

Hey, FFFF, I wanted to send along a story about what happened to me a few weeks ago. About 2 am a friend and I were walking along the north side of Commonwealth. Across the street we could see some kind of free-for-all going on. Then the crowd ran off leaving two people lying on the ground. By the time we crossed over to see what the damage was, the Fullerton police had arrived. The two people, a guy and a woman, were bloodied and obviously beaten. One of the cops saw me observing the scene and asked if I wanted to be arrested.

Rather than provide information about what we had seen, we decided to move on. But before we left I turned around and took this picture showing the woman pleading with four cops who appeared indifferent to whatever physical abuse she had suffered.

Sad. 

Yes, Friend, it is sad. Our “leaders” have created, nurtured, and encouraged a culture of mayhem where sometimes it’s hard to tell the victim from the perpetrator and where the cops are seemingly anesthetized to the weekly blood bath.

It’s SB1421 Day

Today is the Day.

Today Police records are supposed to become a little more transparent and officers with “sustained” complaints (and a few other issues) get to share with the world their bad deeds by virtue of some Sacramento mandated sunshine disinfectant. With SB1421 to the rescue we might finally get to see what happens behind union closed doors when officers misbehave.

The law changing and becoming effective today, owing to the holiday, convinced some friends to put in a few records requests based on suggestions which we complied and others which were emailed to us after this post dropped.

Thanks to everybody who shared what they knew and pointed us in a few interesting directions. I was copied on the request and it contains over 40 officers both current and former, most of whom we believe to have had sustained findings against them. Because police departments refuse to tell us who has findings against them we had to take quite a few guesses based on the best information we could obtain. That or pay FPD $250+ to maybe compile a list per their Public Information Officer.

Being that we’re volunteers who don’t run ads or try to monetize FFFF we opted against the $250 check to FPD.

With the requests in the virtual mail we should be seeing some interesting things provided that the records aren’t obfuscated, buried and denied. We’ll keep you posted as things come back or don’t.

We’re also always open to suggestions so if we missed anybody let us know the details in the comments or via email. Who did what and where should we look? What officers had sustained findings in other departments? We’ll send requests for those records as well.

Who is Acting Police Chief Bob Dunn?

As you may have heard, once again Fullerton has a police chief in hot water. First we had Mike Sellers run away from his post after bungling the Kelly Thomas case, then Danny Hughes decided to give Joe Felz a pass on drunk driving & alleged hit and run and now Chief Hendricks is in trouble for unspecified reasons.

There is no official word on what’s going on from the City because City Manager Ken Domer doesn’t think we have a right to know who’s running our police department and what is happening in our city. However, thanks to a diligent city employee who shall remain nameless reaching out to several of us we know that Hendricks is on a paid vacation (with the benefit of not needing to use his vacation time) for his bad behavior and Captain Bob Dunn is now acting Police Chief.

But who is Bob Dunn?

We wrote about Dunn back in January when he came to our fair city from Anaheim. He was a Lieutenant there and somehow promoted to the position of Captain in Fullerton without much fanfare.

Now he’s been moved to acting Chief. That’s one heck of a jump in 7 months time. Is he really the best man for the job? Is he up to the task? What will he be doing and for how long? Who’s investigating Hendricks? Is Dunn overseeing an IA whitewash or has another agency been called in?

Nobody knows because Ken Domer doesn’t think you have the right to know and the city council can’t be bothered to make him talk.

While You Were Sleeping…

The other day FFFF ran a post on recent efforts by the Fullerton Police Department to share its Heroic doings with the public. Some were struck by the blatant and ongoing hypocrisy of the department’s alleged attitude toward DUI driving, given the fact that our former drunk-driving City Manager, Joe Felz, was given a free pass by the FPD after running off the road, plowing over a tree, and trying to escape the scene of the crime.

Sleepers, awake!

I’m struck by the constant effort of the department to spin PR yarns to make itself look good – despite all the evidence to the contrary.  Get a load of the “while you were sleeping” shtick. It’s the old “we Heroes are keeping the streets of Fullerton safe while you get to sleep safe and sound – and how can you put a price tag on that?” routine. This relentless drum beat of the upbeat continues long after Chief Danny “Galahad” Hughes‘ departure, meaning that the strategy of fooling the public into mistaking a tsunami of PR for reform, is alive and well.

Anyway, I though I’d share a few other FPD activities that happened while we were sleeping, or maybe even when we were wide awake, sort of a public service announcement. Please observe the veritable FPD crime wave:
